Airbnb's community and vision for travel have grown significantly, so we updated our Terms of Service, Payments Terms of Service, and Privacy Policy (collectively, “Terms”).

The Terms are effective immediately for first time users on or after January 21, 2019. Capitalized terms not defined on this page have the same meanings given to them in the Terms. The changes to the Terms of Service and the Payments Terms of Service will go into effect for all existing users on March 27, 2019. When you use Airbnb on or after that day, we’ll ask you to agree to the new Terms of Service and Payments Terms of Service. Please take the time to read them carefully. The updated Privacy Policy will automatically come into effect for all existing users on March 27, 2019. Your continued use of the Airbnb Platform from that day on will be subject to the new Privacy Policy.

Key changes to the Terms include:

Updates to the Terms of Service

  • We made changes to the Terms of Service to make them more concise and easier to understand.
  • In order to better reflect applicable consumer protection laws within the European Economic Area (“EEA”), we have separated our Terms of Service into a version for users residing within the EEA and a version which applies to users residing outside of the EEA.
  • We updated the Terms of Service to reflect new types of services available on Airbnb (such as Pass-Through Tax Feature, Experiences Guest Refund Policy).
  • We updated the arbitration provision.

Updates to Payments Terms of Service

  • We made changes to the Payment Terms of Service to make them easier to read and understand.
  • We added a new contracting entity, Airbnb Payments Luxembourg S.A. (“Airbnb Payments Luxembourg”).
  • We revised and updated our contracting entity language.
  • We added clarifications about payments processed outside your country of residence.
  • We clarified when Airbnb Payments considers outstanding receivables overdue and in default.
  • We updated the arbitration provision.
  • We added new terms for users that contract with Airbnb Payments Luxembourg.
  • We added new clauses for users that are businesses.

  • As a part of Airbnb’s continued expansion and evolution, we’ve added additional information to provide more transparency around those services.
  • We’ve added some clarifications to make it easier to understand our privacy practices.

Here are a few common questions that you may have about this process.
I first registered for my Airbnb account before January 21, 2019. What will happen on March 27, 2019?

Starting from March 27, 2019, users who registered for their Airbnb account before January 21, 2019 will be asked to review and agree to the updated Terms of Service and Payments Terms of Service. You will have to agree to the updated Terms of Service and Payments Terms of Service before you can continue to access your account. If you disagree with these new terms, we'll give you information on your options for completing existing reservations and canceling your account. If you have any questions or encounter any difficulties during this process, please e-mail terms@airbnb.com for assistance. Existing users will not be able to agree earlier than March 27, 2019.

The updated Privacy Policy will automatically come into effect for all existing users on March 27, 2019. Your continued use of the Airbnb Platform from that day on will be subject to the new Privacy Policy.

I first registered for my Airbnb account on or after January 21, 2019. Which Terms apply to me?

If you registered for your Airbnb account on or after January 21, 2019, you already agreed upon registration to the new Terms of Service and Payments Terms of Service. Also, your use of the Airbnb Platform is subject to the new Privacy Policy. These new Terms apply to you and there is nothing more you need to do.

Do these new Terms apply to my upcoming confirmed bookings?

The updated Terms of Service and Payments Terms of Service will apply to all activities (including existing, confirmed bookings) on the Airbnb Platform from the time you agree to them. If you are an existing user and you do not agree to the new terms, the previous version of the Terms of Service, Payments Terms of Service and Privacy Policy will continue to apply to bookings you confirmed before March 27, 2019. However, your continued use of the Airbnb Platform from March 27, 2019 on will be subject to the new Privacy Policy.

The old and new versions of the Terms can be found at the Terms of Service, Payments Terms of Service, Privacy Policy tabs. Both old and new versions will continue to be available through April 27, 2019, after which the tabs will be updated to show only the latest versions.
