We updated our Terms of Service, Payments Terms of Service, and Privacy Policy (collectively, “Terms”).

We’re making some small changes to our Terms of Service, Payments Terms of Service, and Privacy Policy (collectively, “Terms”). The changes are described below. Both the old and new versions of the Terms can be found at the Terms of Service, Payments Terms of Service, and Privacy Policy pages through January 24, 2020. Capitalized terms not defined on this page have the same meanings given to them in the Terms.

Here is a short explanation of the changes.

Updates to Payments Terms of Service

  • We added language explaining details of the consumer complaint process applicable to the users who contract with Airbnb Payments Luxembourg .
  • We added language clarifying that certain amounts processed by Airbnb payments are considered to be down payments or “acomptes” under French law.
  • We added language clarifying that Section 5.2 does not apply to users who contract with Airbnb Payments Luxembourg.

Updates to the Privacy Policy

  • We added language clarifying how personal data is used in connection with processing a request from law enforcement.
  • We added information about the California Consumer Privacy Act.
  • In expectation of Brexit, we added language clarifying that the transfer of personal data from the United Kingdom to the United States relies on Privacy Shield.

Updates to the Terms of Service for European Users

  • We made changes clarifying the scope and nature of the license provided to Airbnb by users when they provide photos and other content.
  • We removed language about overstay fees because they do not apply to European users.
  • We clarified language about how we use feedback from our community.
  • We added a link to make it easier to find an article that discusses our fees.

When do these changes come into effect?

The changes to the Terms of Service, Terms of Service for European Users, and Privacy Policy come into effect 30 days following posting.

The changes to the Payments Terms of Service come into effect 60 days following posting.

The old and new versions of the Terms can be found at the Terms of Service, Payments Terms of Service, Privacy Policy pages. Both old and new versions will continue to be available through January 24, 2020, after which the pages will be updated to show only the latest versions.
