SHORT TERM RENTAL AGREEMENT

This Short Term Rental Agreement (the “Agreement”) is made by and between Glenn Borchardt (“Homeowner”) an(URL HIDDEN)(“Guest”) as of the date last set forth on the signature page of this Agreement. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:

1.Property. The property is located at:

13217 Hillside Drive, Truckee, CA 96161

The property is furnished and includes all common appliances, dishes, silverware, cooking utensils, linens, towels, etc. Bikes and sleds may be used at your own risk.

2.Rental Party: The rental party shall consist of Guest and the following persons:

3.Maximum Occupancy: The maximum number of guests is limited to 18 persons.

4. Minimum Stay: This property requires a 2-night minimum stay. Longer minimum stays may be required during holiday periods. If a rental is taken for less than 2 nights, the guest will be charged the 2-night rate.

5. Rental Rules: Guest agrees to abide by the Rental Rules attached as Exhibit A at all times while at the property and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the following rules at all times while at the property.

6. Access: Guest shall allow Homeowner access to the property for purposes of repair and inspection. Homeowner shall exercise this right of access in a reasonable manner.

7. Security Deposit and Cleaning Fees
The security deposit shall be refunded within 60 days of the Checkout Date provided no deductions are made due to:
i.damage to the property or furnishings;
ii.dirt or other mess requiring excessive cleaning; or
iii.any other cost incurred by Homeowner due to Guest’s stay or failure to lock doors and windows during checkout.
iv.The cleaning fee is non-refundable and applied toward the rental fees. (If the premises appear dirty or damaged upon Check-in, Guest shall inform Homeowner immediately by cal(PHONE NUMBER HIDDEN) or 530-KODODSC.)


8. Cancellation Policy: If Guests wish to cancel their reservation, the deposit will be refunded as follows:

100% if cancelled 30 days prior to the Check-in Date
50% if cancelled 14 days prior to the Check-in Date

9. Insurance: We encourage all renters to purchase traveler insurance. Refunds only will be made for nights missed because of road closures of more than 8 hours.

RENTAL RULES

1.NO smoking inside the cabin. Smoking is allowed outside only.
2.People other than those in the Guest party set forth above may not stay overnight in the property. Any other person in the property is the sole responsibility of Guest.
3.Quiet hours in Tahoe Donner are 10 pm to 6 am. If you disturb the neighbors too much during those hours, you might receive a BIG fine.
4.Donner Ski Cabin is privately owned; the owners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Homeowners are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises.
5.Keep the property and all furnishings in good order.
6.Only use appliances for their intended uses.
7.Pets are NOT allowed.
8.Parking: Parking is limited to 9 vehicle(s). Vehicles are to be parked in the garage and in the driveway only. Parking on the road is not permitted during winter. Any illegally parked cars are subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner. The two guest passes and the two garage door remotes must be returned to the north wall of the garage. The charge for missing remotes is $100 each.
9.Housekeeping: There is no daily housekeeping service. While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. We suggest you bring beach towels. We do not permit towels or linens to be taken from the cabin.
10.Hot Tub: No children under the age of 2 years are permitted in the hot tub at any time. Children younger than 12 years must have adult supervision. When using the hot tub, remember there is a certain health risk associated with this facility. Use at your own risk. On arrival, check the bromine floater to make sure that it contains 2 tablets (stored below the kitchen sink). All guests should take showers before using the hot tub. At the end of the day, please add 1 heaping tablespoon of chlorine shock and turn on the jets. Remember when not using the hot tub, leave cover on so hot tub will stay warm.
11.Fireplace: The downstairs fireplace is propane gas controlled by the thermostat on the south wall of the den. The upstairs fireplace is wood-fired. Please follow the lighting instructions and be sure to close the two vents when you check out. Put ashes in the metal container for disposal by the homeowner. Please do not place any combustible materials on top of or near the fireplaces
12.Sewer: The cabin is on the city sewer system. DO NOT FLUSH anything other than toilet paper. No feminine products should be flushed at anytime. If it is found that feminine products have been flushed and clog the system, you could be charged damages of up to $400.
13.Storms: No refunds will be given for nights missed due to storms unless the roads are officially declared impassable to 4-wheel drive vehicles for more than 8 hours.

This house was amazing. It was cold while we were there and the house was always perfectly warm - everything worked perfectly and there were a lot of supplies on hand - spices and condiments to use. Would go back in a heartbeat.

Great house! It was very comfortable and well-supplied. There were plenty of towels and lots of bedding. The kids loved having the bunk room downstairs while the adults (and one less-adventurous child) took the bedrooms. Instructions were all clearly spelled out in a packet on the counter.

We drove up to the cabin late Christmas Eve afternoon. It was snowing! When we pulled up into the driveway, it was shoveled and ready for us. When we got inside, there were Christmas lights around the big windows and it was toasty warm! The next day, the rest of our big family drove up and we spent a day mostly inside watching the snow. The view out the back is spectacular, and you can see for miles! The day after Christmas was a perfect day, cold with blue skies. We spent most of the day outside, building an igloo and sledding. It was a very memorable holiday! The cabin is beautiful and fully furnished with everything you need for comfort. There was plenty of wood in the garage so we could have a fire going in the living room. It is located in such a beautiful setting. It really was a magical Christmas for us. We would definitely do it again!

Glenn was awesome! Great communication leading up to the trip. FANTASTIC cabin (the pictures don't do it justice). Great vibe and energy. We accidentally fell into the TV and broke it during our stay -- Glenn was very accommodating, and found a good deal for us on a used tv of the same model, rather than sending us a bill for a brand new top of the line TV. Thanks for saving us money on that Glenn. Can't say enough positive things!

Although I have produced over 400 scientific reports, including journal articles, chapters, books, and computer programs, the best by far is my book, "The Scientific Worldview: Beyond Newton and Einstein" (Understanding the Universal Mechanism of Evolution)" (iUniverse, 2007). It poses the ultimate challenge to the current, wildly popular, though absurd claim that the universe is finite and that it exploded out of nothing. The book is completely logical from beginning to end in support of an infinite universe and a scientific philosophical approach that will replace the Big Bang Theory and the "systems philosophy" supporting it. The challenge for me is to get readers intelligent enough and educated enough to handle the ideas presented and to understand the book's great significance. The paradigm that I propose is antithetical to conventional physics and astronomy and cannot be taken seriously by those who hold the idealism of mathematics to be the true test of reality.
