This Rental Agreement and Contract (the “Agreement”) is a legally binding agreement made and entered into as of the Reservation Date written below by and between the undersigned person(s) or company (the “Guest”) and the undersigned owner, manager or agent (“Rental Agent”), pursuant to which the Guest has agreed to rent the residence described below (the “Property”), for the duration of the Rental Term for the Total Rental Fee and other good and valuable consideration as described herein.
Guest agrees that no more than  persons shall be permitted on the Property at anytime during the Rental Term, all of whom shall comply with the conditions and restrictions imposed upon Guest under this Agreement.
CONDITION AND USE OF PROPERTY
The Property is provided in “as is” condition. Rental Agent shall use its best efforts to ensure the operation of all amenities in the Property, such as internet access, satellite or cable TV access or hot tubs, fireplaces as applicable. Rental Agent shall not be held responsible for such items failure to work, but will make every effort to correct any issues as reported as quickly as possible. Guest acknowledges that use of amenities such as hot tubs, pools, spas, fireplaces, decks, and the like may be potentially dangerous and involve potential risks if improperly used, particularly with regard to children and such use is at the Guest’s own risk.
Guest shall use the Property for residential purposes only and in a careful manner to prevent any damage or loss to the Property and keep the Property in clean and sanitary condition at all times. Guest and any additional permitted guests shall refrain from loud noise and shall not disturb, annoy, endanger, or inconvenience neighbors, nor shall Guest use the Property for any immoral, offensive or unlawful purposes, nor violate any law, association rules or ordinance, nor commit waste or nuisance on or about the Property.
If Guest should fail to comply with the conditions and obligations of this Agreement, Guest shall surrender the Property, remove all Guest’s property and belongings and leave the Property in good order and free of damage. No refund of any portion of the Total Rental Fee shall be made and if any legal action is necessary, the prevailing party shall be entitled to reimbursement from the other party for all costs incurred.
ASSIGNMENT OR SUBLEASE
Guest shall not assign or sublease the Property or permit the use of any portion of the Property by other persons who are not family members or guests of the Guest and
included within the number of and as permitted occupants under this Agreement.
RISK OF LOSS AND INDEMNIFICATION
Guest agrees that all personal property, furnishings, personal affects and other items brought into the Property by Guest or their permitted guests and visitors shall be at the sole risk of Guest with regard to any theft, damage, destruction or other loss and Rental
Agent shall not be responsible or liable for any reason whatsoever.
Guest hereby covenants and agrees to indemnify and hold harmless Rental Agent and their agents, owners, successors, employees and contractors from and against any costs, damages, liabilities, claims, legal fees and other actions for any damages, costs, attorneys fees incurred by Guest, permitted guests, visitors or agents, representatives or successors of Guest due to any claims relating to destruction of property or injury to persons or loss of life sustained by Guest or family and visitors of Guest in or about the Property and Guest expressly agrees to save and hold Rental Agent harmless in all such cases.
Guest hereby waives and releases any claims against Rental Agent, the Property owner and their successors, assigns, employees or representatives, officially or otherwise, for any injuries or death that may be sustained by Guest on or near or adjacent to the Property, including any common facilities, activities or amenities. Guest agrees to use any such facilities or amenities entirely at the Guest’s own initiative, risk and
ENTRY AND INSPECTION
Rental Agent reserves the right to enter the Property at reasonable times and with reasonable advance notice for the purposes of inspecting the Property or showing the Property to prospective purchasers, renters or other authorized persons. If Rental Agent has a reasonable belief that there is imminent danger to any person or property, Rental Agent may enter the Property without advance notice.
UNAVAILABILITY OF PROPERTY
In the event the Property is not available for use during the Rental Term due to reasons, events or circumstances beyond the control of Rental Agent, Rental Agent will apply due diligence and good faith efforts to locate a replacement property that equals or exceeds the Property with respect to occupancy capacity, location and value that meets the reasonable satisfaction of the Guest. If such replacement property cannot be found and made available, Rental Agent shall immediately return all payments made by the Guest, whereupon this Agreement shall be terminated and Guest and Rental Agent shall have no further obligations or liabilities in any manner pertaining to this Agreement.
ADDITIONAL TERMS TO THE RENAL AGREEMENT
In addition to the standard terms included herein, Guest acknowledges and
agrees that the following additional terms and conditions apply to the Guest’s rental of the Property:
1- Check- in time is after 3:00 pm and Check out is 10:00 am -NO EARLY CHECK IN OR OUT.
2- This is a NON-SMOKING unit.
3- Pets are permitted in rental unit under certain conditions. Rent must disclose that there will be a pet.
4- We will not rent to vacationing students or singles under 21 years of age unless accompanied by an adult guardian or parent.
5- DAMAGE/ RESERVATION DEPOSIT: A damage/ reservation deposit of U$ 300.00 is required. This must be received when keys are collected. The deposit automatically converts to a security / damage deposit upon arrival. The deposit is not applied toward rent; however, it is fully refundable, upon your departure, provided the following provisions are met.
a- No damage is done to unit or it's contents, beyond normal wear and tear.
b- No charge is incurred due to contraband, pets or collections of rents or services rendered during the stay.
c- All debris, rubbish and discard are placed in dumpster, and soiled dishes cleaned.
d- All keys are surrendered as instructed and unit is left locked.
e- All charges accrued during the stay are paid prior departure.
f- No linens are lost or damaged.
g- No early check in or late check out.
h- The renter is not evicted by owner (or representative of the owner), the local law enforcement, the security company employed by my complex.
j- Owner will specify if the reservation deposit will be required. Otherwise they will require the property damage insurance.
6- PAYMENTS- An advance payment equal to 50% of the rental rate is required at the reservation time. The advanced payment will be applied toward the room rent. Please make payment in form of: credit card/ cash/ direct deposit or wire transfer. The advance deposit is not a damage deposit. The balance due of the rent is due 15 days prior arrival.
7-CANCELLATION - A thirty (60) day notice is required for cancellations.
Cancellations that are made more than (60) days prior the arrival date will incur NO penalty. Cancellations or changes that result in a shortened stay, that are made within 60 days of arrival date, forfeit the full advance payment and damage/ reservation deposit.
8- MAXIMUM OCCUPANCY- The maximum number of guest per house is limited to (3) person. NO EXCEPTIONS. Fee will apply per person per night for guest in addition to (3) persons.
9- LONGE MINIMUM STAY- May be required during holiday periods. If a rental is taken for less than three days, the guest will be charged the three-night rate.
10- INCLUSIVE FEES- Rates include a onetime linen-towel set up. Amenity fees are included in the rental rate.
11- NO DAILY MAID SERVICE- while linens and bath towels are included in the unit, daily maid services is not included in the rental rate, however is available at an additional rate. We do not permit towels or linens to taken from units.
12- RATE CHANGES- Rates subject to change without notice. When the contract is signed rates are final.
13- FALSIFIED RESERVATIONS- Any reservation obtained under false pretense will be
subject to forfeiture of advance payment, deposit and or rental money, and the party will not be permitted to check in.
14- WRITTEN EXCEPTIONS- Any exceptions to the above mentioned policies must be approved in written in advance.
15- HURRICANE OR STORM POLICY- No refund will be given unless:
a- The national weather service orders mandatory evacuation in a storm/ hurricane warning area and or
b- A mandatory evacuation order has been given for the storm/ hurricane warning , we will refund :
1- Any unused portion of the rental from guest currently registered,
2- Any unused portion of the rent from guest that is scheduled to arrive, and wants to shorten their stay, to come in after the hurricane warning is lifted; and
3- Any advance rents collected or deposit for reservation that is scheduled to arrival during the hurricane warning period.
16- HOUSE RULES - Tenant agrees to follow all house rules as follows:
1. No smoking inside: Renters agree to not smoke on property and it is understood that if they do they will be held liable for all costs associated with removing the smoke odor from the entire property. Smoking outside in the balcony is allowed.
2. No guests of guests: No overnight guest of guest is allowed. No exceptions
3. No moving furniture: We appreciate if you do not rearrange the furniture. Unless is necessary for the using the sofa bed in the living room.
4. No bath towels at the beach: Do not take bath towels to the beach. We provide you with (4) beach towels.
5. No burning candles: We request that you do not burn candles inside the condo at anytime.
6. Pets: Allowed only with advance written permission of the property owner.
7. QUIET TIMES: No parties allowed. Renters understand that parties, excessive noise/music, or functions of any sort are not permitted on property without
expressed permission in writing from the Property Manager.
8. No loud noise or music is allowed past 9PM ET. For guest’s enjoyment and the enjoyment of other, please strictly respect quiet times between 9PM and 8AM ET.
9. Renters agree that lost keys will incur a charge for all costs associated with having the locks re-keyed or replaced.
10.Renters agree to make known the terms of this Rental Agreement and all
property specific House Rules to all Renters and their guests. Renter also agrees that if upon check in there is not a copy of the House Rules then they must
promptly request a copy via email from the Property Manager.
11.Renters agree to be completely responsible for any and all damage to the
property caused intentionally or unintentionally by Renters or by their guests.
Renters agree to pay for all costs associated with broken, damaged, or missing property, which includes the structure itself.
12.Renters agree that they cannot hold the Property Manager responsible for any items left behind after check out.
13.Renters agree to lock all doors upon check-out. Renters will forfeit security deposit if doors are not locked upon check-out.
14.Renters agree that they cannot hold the Property Manager responsible for any items left behind after check out
15.Renter understands that the Property Manager reserves the right to refuse service to anyone at their discretion.
16.Failure to observe all house rules may result in immediate termination of rental and eviction of property without monetary refund of any unused portion of rental.
17- LIABILITY - Tenant assumes all risks & full liability for any & all injuries incurred during the rental period inside & outside of unit.

This Agreement contains the entire agreement between the parties with regard to the rental of the Property, and any changes, amendments or modifications hereof shall be void unless the same are in writing and signed by both the Guest and the Rental Agent.
This Agreement shall be governed by the laws of the Commonwealth of Florida. The words “Rental Agent” and “Guest” shall include their respective heirs, successors, representatives. The waiver or failure to enforce any breach or provision of this Agreement shall not be considered a waver of that or any other provision in any subsequent breach thereof. If any provision herein is held invalid, the remainder of the Agreement shall not be affected. Any notice required to be given under this Agreement shall be in writing and sent to the contact information included herein. This Agreement may be signed in one or more counterparts, each of which is an original, but taken together constitute one in the same instrument. Execution of a digital signature shall be deemed a valid signature.
