1)CARE OF PROPERTY: The Tenant agrees to treat the property with care:
i)Marble countertops and other delicate surfaces will be cleaned regularly and kept clean of stains, especially from red wine or coffee.
ii)All debris, rubbish and discards will be placed in outside trash bins at the front of the property, and soiled dishes will be placed in the dishwasher and cleaned.
iii)Upon checkout, exterior doors and windows will be locked and all keys will be returned to and locked in the lockbox.
2)TERM: The term of the Rental Agreement begins on the Check-in Date and ends on the Check-out Date. The hourly rate for holding over past the Check-our Date is $100 per hour. NO early check-in or late check-out.
3)NO SMOKING: This is a NON SMOKING unit, inside or outside. If there is evidence that smoking took place, Tenant agrees to pay a minimum of $500.00 for the required indoors deep cleaning and/or $100 for outdoor pickup and cleaning.
4)PETS: Pets are not permitted. Pets on the premises will result in a fine of $300.
5)AGE RESTRICTIONS: We will not rent to singles under 25 years of age unless accompanied by an adult guardian or parent. Tenant, in signing this agreement, confirms that the adults in the party are all over 25 years of age.
6)SHORT TERM OCCUPANCY: Tenants expressly acknowledge and agree that this Agreement is for transient occupancy of the Property, and that Tenants do not intend to make the property a residence or household.
7)GAS APPLIANCES: Tenant is advised that the property contains a gas stove and cook top, gas heating, and other gas powered items and will seek help from Landlord if the proper operation of such items is not fully understood.
8)SAFETY AND SECURITY: Tenant shall see to their own security and the security of the furniture and appliances while in the property by locking doors, windows, etc.
9)INTERNET: High speed wireless internet is provided as a convenience only and is not integral to the agreement. No refund of rents shall be given for outages, content, lack of content, speed, access problems, lack of knowledge of use, or personal preferences with regard to internet service.
10)CLIMATE CONTROLS: Tenant agrees that air conditioning shall be set within the range of 70 to 73 degrees Fahrenheit, and that the fan setting shall be “Auto”. Doors and windows shall be closed when either heat or air conditioning is in operation.
11)PAYMENT: An advance payment equal to 100% of the rental amount is required at the time of booking.
12)SECURITY DEPOSIT: A refundable security deposit is required at the time of booking. Any damages and/or additional cleaning needed will be deducted accordingly.
i)§92.108, Texas Property Code provides that a tenant may not withhold payment of any portion of the last month’s rent on grounds that the security deposit is security for unpaid rent.
ii)If deductions exceed the security deposit, Tenant will pay to Landlord the excess within ten (10) days after Landlord makes written demand.
iii)Bad faith violations of §92.108 may subject a tenant to liability up to three (3) times the rent wrongfully withheld and the landlord’s reasonable attorney’s fees.
iv)The Property Code does not obligate a landlord to return or account for the security deposit until the tenant surrenders the Property and gives the landlord a written statement of the tenant’s forwarding address, after which the landlord has thirty (30) days in which to account.
v)“Surrender of premises”: Upon the expiration of the term hereof, Tenant shall surrender the Premises in as good a state and condition as they were at the commencement of this Agreement, reasonable use and wear and tear thereof and damages by the elements excepted. .
vi)One may view the Texas Property Code at the Texas Legislature’s website which, as of the date of the last revision of this lease, is http://tlo2.(email hidden)/statutes/pr.toc.htm.
Landlord may deduct reasonable charges from the Security Deposit for the items listed below.
i)damages to the Property, excluding normal wear and tear;
ii)attorney’s fees, costs of court, costs of service, and other reasonable costs incurred in any legal proceeding against Tenant;
iii)Landlord’s cost to access the Property if made inaccessible by Tenant;
iv)mailing costs associated with sending notices to Tenant for any violations of this lease;
v)packing, removing, and storing abandoned property;
vi)removing abandoned or illegally parked vehicles;
vii)replacing unreturned keys, garage door openers, security devices, or other components;
viii)the removal of unauthorized locks or fixtures installed by Tenant;
ix)unpaid charges or fees for which Tenant is responsible under this lease;
x)other unpaid late charges, rents;
xi)long distance calls, cable charges, etc.
xii)pet or smoking related charges;
xiii)treatment of stains on the marble countertops;
xiv)other items Tenant is responsible to pay under this lease.
13)CANCELLATIONS: A sixty (60) day notice is required for cancellation. Cancellations that are made more than sixty (60) days prior to the arrival date are subject to a 5% Cancellation fee or $50 whichever is greater. Cancellations or changes that result in a shortened stay, or that are made within sixty (60) days of the arrival date, forfeit the full Advance Payment and Security Deposit. Cancellation or early departure does not warrant any refund of rent or deposit. You may choose to purchase travel insurance separately.
14)CREDIT CARD AUTHORIZATION: Tenant authorizes Landlord to use the Guest’s credit card information for payment of all fees and penalties outlined in this rental agreement. Tenant also certifies that Tenant is authorized to use the credit card provided.
15)MAXIMUM PEOPLE: The maximum number of adults who can stay at the Property is equal to Number of Overnight Guests, defined in the Definitions section of this document. No more than fifteen (15) people (“Maximum People”) may be in or around the Property at any given time. If the number of people in or around the Property exceeds the Maximum People, then the Landlord will have the right to terminate this rental agreement immediately and the Tenant will evacuate the property promptly and waive all rights to refund, reimbursement, or damages.
16)MINIMUM STAY: This property requires a three (3) night minimum stay. Longer minimum stays may be required during holiday periods. If a rental is taken for less than three days, the guest will be charged the three-night rate. Exceptions can be made if expressly agreed to and stated in confirmation email.
17)NO DAILY MAID SERVICE: While linens and bath towels are included in the unit, daily maid service is not included in the rental rate however is available at an additional rate. We do not permit towels or linens to be taken from the unit.
18)RATE CHANGES: Published rates are subject to change without notice.
19)AVAILABILITY OF PROPERTY: In the event that the Landlord is unable to deliver the Property to Tenant under this Rental Agreement prior to occupancy because of fire, eminent domain, act of nature, delay in construction, bankruptcy, loan default, sale of property, or any other reason whatsoever, Tenant hereby agrees that Landlord’s sole liability as a result of these conditions is a full refund of all consideration previously tendered by Tenant. Pursuant to the terms of this lease, Tenant expressly acknowledges that in no event shall the Landlord be held liable for any consequential or secondary damages, including but not limited to, any expenses incurred as a result of moving if the property becomes unavailable.
20)FALSIFIED RESERVATIONS: Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to check-in.
21)WEATHER OR STORM POLICY: No refunds will be given. It is highly recommended that Tenants consider the purchase of travel insurance. Travel insurance is available from insurance companies at web sites like (website hidden).
22)ASSIGNMENT AND SUB-LETTING. Tenant shall not assign this Agreement, or sub-let or grant any license to use the Premises or any part thereof without the prior written consent of Landlord. A consent by Landlord to one such assignment, sub-letting or license shall not be deemed to be a consent to any subsequent assignment, sub-letting or license. An assignment, sub-letting or license without the prior written consent of Landlord or an assignment or sub-letting by operation of law shall be absolutely null and void and shall, at Landlord's option, terminate this Agreement.
23)ALTERATIONS AND IMPROVEMENTS. Tenant shall make no alterations to the buildings or improvements on the Premises or construct any building or make any other improvements on the Premises without the prior written consent of Landlord. Any and all alterations, changes, and/or improvements built, constructed or placed on the Premises by Tenant shall, unless otherwise provided by written agreement between Landlord and Tenant, be and become the property of Landlord and remain on the Premises at the expiration or earlier termination of this Agreement.
24)CONDUCT: The Tenants shall behave in a civilized manner and shall be good neighbors respecting the rights of the surrounding property owners. The Tenants shall not create noise or disturbances likely to disturb or annoy the surrounding property owners. Creating a disturbance of the above nature shall be grounds for immediate termination of this agreement and Tenants shall then immediately vacate the premises. Quiet hour starts at 10 PM and outdoor noise should be kept to a minimum. Tenant agrees that Fireworks and other hazardous materials shall not be used in or around the property. Tenant shall use the property for legal purposes only and other use, such as but not limited to, illegal drug use, abuse of any person, harboring fugitives, etc.; shall cause termination of this agreement with no refund of rents or deposits.
25)PERSONAL PROPERTY: Tenant understands that any personal property of and used by Tenant is not insured by Landlord and Landlord shall not be responsible for any lost, stolen or missing property of the Tenant.
26)PROPERTY FOR SALE: If the property is listed on the market for sale at the time of the lease, it may be shown to qualified buyers during the Tenants’ stay. Every effort will be made to schedule the showing at a convenient time and not interrupt the Tenant’s vacation. Tenant shall allow reasonable viewings of the home between 9AM and 7PM, present or not.
27)REMEDIES: If the Tenant defaults under or breaches any provision of the Rental Agreement, particularly, but not limited to Tenants unauthorized "holding over" or those acts mentioned above in this agreement, and in addition to all other rights and remedies Landlord may have at law, Landlord shall have the option, upon written notice or as the Law may hereinafter provide, to immediately re-enter and remove all persons and property from premises. In such an instance, the Rental Agreement will be terminated, and Landlord shall be entitled to keep all amounts paid by the Tenant and otherwise recover all damages allowable under the Law. The Tenant, as part of the considerations of this special rental, in recognition that this property is booked in advance by other Tenants throughout the year, hereby waives all claims for damages that might be caused by Landlord’s re-entry and taking possession of premises or removing or storing furniture and property as herein provided, and will hold Landlord harmless from loss, costs and damages occasioned thereof, and no such re-entry shall be considered or construed to be a forcible entry as defined in state statutory provisions. Further, if for any reason Landlord is unable to deliver possession of the premises to Tenant at the commencement of the term specified under this agreement, Landlord shall refund amounts paid by Tenant, but shall not be liable for any other damages caused thereby.
28)ATTORNEYS' FEES. Should it become necessary for Landlord to employ an attorney to enforce any of the conditions or covenants hereof, including the collection of rentals or gaining possession of the Premises, Tenant agrees to pay all expenses so incurred, including a reasonable attorneys' fee.
29)INDEMNIFICATION. LANDLORD SHALL NOT BE LIABLE FOR ANY DAMAGE OR INJURY OF OR TO THE TENANT, TENANT'S FAMILY, GUESTS, INVITEES, AGENTS OR EMPLOYEES OR TO ANY OTHER PERSON ENTERING THE PREMISES OR ANY BUILDING THAT IS A PART OR LIES UPON THE PREMISES, OR TO GOODS OR EQUIPMENT, OR IN THE STRUCTURE OR EQUIPMENT OF THE STRUCTURE OF WHICH THE PREMISES ARE A PART, AND TENANT HEREBY AGREES TO INDEMNIFY, DEFEND AND HOLD LANDLORD HARMLESS FROM ANY AND ALL CLAIMS OR ASSERTIONS OF EVERY KIND AND NATURE. THIS INDEMNIFICATION INCLUDES, BUT IS NOT LIMITED TO, ANY DAMAGE OR INJURY WHICH MAY BE INCURRED BY TENANT, TENANT'S FAMILY, GUESTS, INVITEES, AGENTS OR EMPLOYEES OR TO ANY OTHER PERSON FOR DAMAGE OR INJURIES THAT ARISE FROM ANY CONTACT, ATTACK OR INTERACTION FROM OR WITH ANY ANIMALS, DOMESTIC OR WILD, WHETHER SUCH DAMAGE OR INJURY OCCURS ON THE PREMISES OR OFF, AND TENANT HOLDS HARMLESS THE LANDLORD FROM ANY AND ALL CLAIMS OR ASSERTIONS OF EVERY KIND AND NATURE FOR ANY DAMAGE OR INJURY TENANT ATTRIBUTES TO ANY ABSENCE OR FAILURE OF FENCING THAT MAY BE ON OR SURROUNDING THE PREMISES.
30)POOL USAGE: THE TENANT EXPRESSLY ACKNOWLEDGES THAT USE OF THE SWIMMING POOL DURING THE TERM OF THE RENTAL AGREEMENT OR BY THE TENANT OR HIS OR HER INVITEES IS AT THE RISK OF THE PERSON MAKING USE OF THE SWIMMING POOL. THE TENANT EXPRESSLY ASSUMES ANY LIABILITY ARISING OUT OF, RELATING TO OR RESULTING FROM USE OF THE POOL DURING THE TERM OF THE RENTAL AGREEMENT, EXPRESSLY AGREES TO HOLD LANDLORD HARMLESS FROM AND AGAINST ANY LIABILITY ARISING OUT OF OR RELATING TO USE OF THE SWIMMING POOL AND EXPRESSLY ACKNOWLEDGES THAT NO LIFE GUARD IS ON DUTY.
31)EFFECT OF EXECUTION: By signing below, Tenant hereby acknowledges and agrees that (i) all payments made to Landlord are non-refundable, (ii) he, she or it has read his, her or its rights to purchase travel insurance and (iii) he, she or it agrees to all terms and conditions of the Rental Agreement.
32)VENUE: The parties to this Agreement agree to exclusive personal jurisdiction and venue in the state and federal courts of Travis County, Texas.
33)GOVERNING LAW: This Agreement shall be governed, construed and interpreted by, through and under the Laws of the State of Texas.
34)DISPUTE RESOLUTION: Tenant and Landlord agree to attempt to resolve disputes arising from this agreement, products, and services it encompasses through binding arbitration at a mutually agreed-upon location in Austin, TX.
35)SEVERABILITY. If any provision of this Agreement or the application thereof shall, for any reason and to any extent, be invalid or unenforceable, neither the remainder of this Agreement nor the application of the provision to other persons, entities or circumstances shall be affected thereby, but instead shall be enforced to the maximum extent permitted by law.
36)BINDING EFFECT. The covenants, obligations and conditions herein contained shall be binding on and inure to the benefit of the heirs, legal representatives, and assigns of the parties hereto.
37)DESCRIPTIVE HEADINGS. The descriptive headings used herein are for convenience of reference only and they are not intended to have any effect whatsoever in determining the rights or obligations of the Landlord or Tenant.
38)CONSTRUCTION. The pronouns used herein shall include, where appropriate, either gender or both, singular and plural.
39)NON-WAIVER. No indulgence, waiver, election or non-election by Landlord under this Agreement shall affect Tenant's duties and liabilities hereunder.
40)MODIFICATION. The parties hereby agree that this document contains the entire agreement between the parties and this Agreement shall not be modified, changed, altered or amended in any way except through a written amendment signed by all of the parties hereto.

The house was outstanding. It easily accommodated our business group. It was comfortable and relaxing. The kitchen was very modern and well-equipped. The price was a value compared to the cost of hotel rooms. Excellent location near downtown and other attractions. Would definitely stay there again.
Courtney is absolutely wonderful; super responsive and accommodating. This place is HUGE. Perfect spot for our reunion weekend of 4 couples from business school. The location is great for getting to all the fun spots in Austin- 6th street, South Congress, Rainey Street, and the paths along the river. We got everywhere we wanted to go very quickly and conveniently!
We had a girls weekend in Austin for a friend's birthday. This was the perfect house. Lots of space and plenty of bedrooms. Courtney was even nice enough to check-in a little early and check-out a little late. She was very accommodating to our flight schedules. The house was clean. The essentials were provided: bath towels, beach towels, hand soap, etc. The kitchen also had all the necessities: pots, pans, spices, utensils, glasses, etc. we cooked breakfast in the morning so it was very convenient. Also, there is a large table-- so we could all sit together.
The pool was the perfect addition. Don't forget your bug spray. We were out at the fenced/private pool ALL afternoon (in August), and definitely attracted some bugs. The pool area was clean. There wasn't a lot of space around the pool, but there was a whole other section to the backyard so we continued our fun in that area.
The neighborhood was very nice. It was quiet. We found out the "neighbors" next door were also renting for the weekend. You could walk to things if you needed to-- things were about 1 mile away. A short taxi cab got you to downtown and SoCo.
Overall, excellent stay. Perfect for what we needed. House is great! Updated kitchen and nice size bedrooms. Also, there is a driveway area if you bring a car and want it off the street.
Lastly, she didn't make you do a lot of "cleaning" when you left. Take out the trash and put dishes in the dishwasher. Simple! Less stress and no worry when you leave.
