The Space

House is normally rented for full weeks, Sunday to Sunday (less traffic). If we have a cancellation or an open week we may rent the house on a partial week basis.

SOUND MIND & BODY sits right on Pamlico sound. Private beach/water access, million dollar views, stunning sunsets, hot tub, wrap around deck. Perfect soundfront location for a relaxed vacation - unwind and recharge! Windusrfing, kiteboarding, kayaking, sailing, fishing, surfing abound - this is a watersportsman's dream! Set up and launch right from the backyard - no need to pack your gear and drive every time you want to play on the water :) Can't beat that!

Quaint fisherman village with sailboats and fresh catch for your family barbeque. Nearby Spa, swimming pool, tennis courts.

Very quiet, family friendly. Folks often ask me why I choose to be on the sound side instead of the ocean. It's a matter of personal preference, of course. But here are my thoughts:

Sound vs. Ocean side...
Sound side is more serene, relaxed and quiet and you don't feel like you are sharing your vacation with hundreds of other beach goers. Having said that if you want to mix and match you can always cross to the Ocean side - takes 5 min.
I am not an early riser, so even though I love sunrises on the ocean side I am not usually up that early to enjoy them, especially when on vacation. This makes the sunset displays off our deck one of the biggest highlights of this location.
If you have children in your party, depending on how old they are being on the Sound side can be a great advantage - no violent waves or rip currents to worry about. They can simply walk into the calm water and swim, play and enjoy. You also get the homey feel and a contained space where it is easier to watch the kids as it's just you and your family on the beach. Teenagers may want to do some kayaking, windsurfing, sailing or kiteboarding - all better suited for the sound side.
I also like the fact that you can walk to the local fisherman village, watch the sailboats and the simple life that goes on there - just a different feel, more local, less touristy. It's a matter of preference.
If you or your kids/family are into kitesurfing/windsurfing/kayaking/sailing - Sound side is the place to be! Prevailing winds are side-on-shore SW and the water is relatively shallow making it a safer environment for the wind/water sport enthusiasts to enjoy their hobbies. For surfers on the other hand, Oceanside location is certainly the place to be.
All that said, some folks prefer Oceanside locations and there are certainly plenty of gorgeous spots to choose from! Those are usually quite a bit more expensive though.

About the neighborhood:
Avon is Rustic and full of energy. It is a kiteboarding and windsurfing mecca due to ideal wind and beach conditions.
Avon is an old Hatteras Island village that has become synonymous with recreational surf fishing, and the Avon pier is a hot spot for those in pursuit of big gamefish like Red Drum. Just north of Buxton, this once tiny village of watermen and their families has grown to be a highly coveted vacationing experience with pristine, natural beaches and beautiful rental cottages. But Avon still retains its tight knit community feel. Even though you can find fantastic seafood restaurants, a supermarket, and some of the conveniences of home, a rustic atmosphere still permeates Avon.

You may hear Avon referred to as Kinnakeet by some locals. It was the name local tribe of Algonkian Indians gave the area, and later adopted by settlers. But in 1883, the U.S. Postal Service redubbed the village Avon, like they did with most of the Hatteras Island communities.

On the sound side of Avon, on the western side of Highway 12, you may see kiteboarders performing amazing aerial stunts and windsurfers racing across the surface of the Pamlico Sound. Nearby Kite point and Canadian Hole were named after the popularity of this public access spots with kiteboarders and with our visitors from the north. In the early spring, many watersports lovers flock here from Canada, Massachusets, New York, New Jersey, Pennsylvania and other points north, because it is still quite cold at home and these enthusiastic athletes can't wait to have a little fun on the water.

Getting Around

Car, bike, sailboat, kitesurfing and windsurfing :) . Walk to the other side of the island is 0.9 mile. Food Lyon shopping plaza is a 5 min drive.

House guests need to tidy up - remove trash, vacuum clean, clean up in bathrooms, kitchen etc. before they leave and secure the keys back in the lock box. Lost key charge is $80 for labor, hardware and materials to change the locks. No pets or smoking allowed inside the house or anywhere on premises.

We are members of Kinnakeet Shores Pool and Tennis club which guests are able to use.

Rental Agreement:

One guest must be appointed “leader” of the group. This person must demonstrate maturity, take responsibility for the actions of the group and report any issues or property damage to us immediately.

The guest “leader” must do a walk-through of the property prior to check-out to assure the house is tidy and all items are as originally found and in good order.

Check in is at 4 p.m. and check out is at 10 a.m.

Absolutely NO smoking of any kind, drugs or fumigating is allowed in house or anywhere on premises. Smoking and pets are NOT allowed under any circumstances. The entire security deposit will be used to professionally clean and deodorize the apartment and furniture if this rule is violated.

Please be discrete and respect the neighbors.

Number of Guests: maximum of 13 guests can stay at the house at any one time. No additional guests are allowed.

FURNITURE & EQUIPMENT – Please DO NOT move or rearrange our furniture. Taking indoor furniture outside is not allowed. Taking kitchen equipment (glasses, dishes, etc.) off-premises is not allowed.

Removing any items from the apartment is not allowed. All items are videotaped prior to guest’s arrival and inspected after departure.

Any damaged items must be replaced by guest at their expense.

Keys: all keys have to be returned to lockbox and lockbox keys scrambled prior to departure.

Lost keys: the charge for replacing the lock and keys is $80 for hardware and labor which will be withheld from security deposit.

TELEVISION/DVD/INTERNET/WIFI – While televisions (and a DVD player) are provided in the living room and bedrooms, no refunds will be given for any malfunctions, faulty internet reception or electronic equipment. All TVs are "smart" TVs and can stream movies and TV channels from your Netflix, Amazon, Hulu etc. accounts. High Speed 100Mbs Internet/Wi-Fi access is provided, but no guarantees are given for uninterrupted service, use or download/streeming speeds.

WASTE DISPOSAL:
•Please dispose trash in the black containers provided
•Trash removal days in Avon are Tuesday and Friday, so please take the trash out the NIGHT PRIOR - Monday night and Thursday night and roll the black bins out to the curb in front of the house
•Please DO NOT FLUSH anything other than toilet paper in the toilet. No feminine products should be flushed at any time. If it is found that feminine products have been flushed and clog the septic system, you could be charged damages of up to the value of security deposit.

Please DO NOT burn candles inside or outside of our home.

Please use extreme caution when operating our charcoal grill or the firepit. Please do not use during high winds as it can carry the sparks onto structures. Firewood and charcoal are not supplied.

Fireplace is used during cold months only. Please exercise caution while using fireplace. Fireplace is turned off and can not be used during the summer months.

Please turn off air conditioning before leaving apartment and while away.

Please do not have windows open while air conditioning is on. Please do not turn air conditioning thermostat below 68 degrees so as to allow gradual adjustment and not to overheat the a/c unit.

Please do not have windows open while air conditioning is on.

Please don't overfill the refrigerator when you arrive or it may not work properly.

Please tidy up and leave the place as you found it.

Please do not open owner’s closets.

During high season months - June 1st - September 1st - Full refund will be issued for cancellations that are requested 3 months prior to arrival date. Cancellations requested within 3 months prior to arrival date will be charged $1,000 re-booking fee. Remainder will be refunded if we can re-book your week. These prime season weeks are booked by families several months in advance and are difficult to fill last minute.

Inclement weather and other unforeseen circumstances beyond our control: we do NOT offer refunds for hurricanes, storms, emergencies or mandatory evacuations. However, you may purchase travel insurance from the company you use to make your reservation to cover this possibility.

A total reservation/security deposit of $500 is paid within five (5) days of booking the reservation.

This security deposit will be refunded according to the terms outlined in the Reservation/Security Deposit section of this document.

Guests must agree to visits by the owner, inspector or a representative during the week to check the condition of the property, or to fix any issues, if necessary.

PARTIAL WEEKS/MINIMUM STAY – Partial week rentals may be reserved for Off-Season weeks. Partial week rentals may be reserved any time for Winter Season weeks. (Other fees and deposits apply.)

LINENS and TOWELS– Sheets, bath towels and kitchen towels will be provided, however you will need to remove them from the beds and leave on top of each bed prior to departure. We do not permit our towels or sheets to be taken outside of the home. If any of these items or anything else in the apartment is missing after guest’s stay, entire security deposit can be retain to compensate for the loss. Beach towels are not provided, so please bring your own.

ISSUES, QUESTIONS, HOUSEKEEPING & MAINTENANCE – Please notify the owner if you have any problems during your stay. We strive to make any necessary repairs within 24 to 48 hours, however, sometimes we are forced to wait for delivery, parts and/or experienced repair personnel. No refunds will be given for inoperable appliances, faulty equipment, unfavorable weather, early departure, interruption of utilities, construction in the area, the building or maintenance problems. False or unwarranted repair calls initiated by tenant will be billed to the tenant. Owner reserves the right to enter premises during tenancy to inspect, make repairs, etc.

DAILY HOUSEKEEPING SERVICE – Daily maid service is not provided. If you are interested in this option, please let us know prior to your arrival and we will try to assist you.

RATE CHANGES – Rates are subject to change without notice prior booking.

FALSIFIED RESERVATIONS – Any reservation obtained under false pretenses will be subject to forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to check in.

PRIVACY – We ask for your contact information for communication purposes only. We will never give (or sell) your information to anyone else for any reason. We kindly ask for the same.

We reserve the right to withhold entire security deposit if any of the above rules are violated.

INDEMNITY – In the event that we are not unable to deliver said property to tenant under the terms of this lease agreement because of fire, damages, eminent domain or act of nature, or if the property is unavailable because of delay in construction, lack of water or sewer, the home is sold and no longer renting, or the home is otherwise unfit and uninhabitable, tenant hereby agrees that the owner’s sole liability as a result of any of these conditions is the full refund of all consideration previously tendered by the tenant pursuant to the terms of this lease and tenant expressly acknowledges that in no event shall owner be held liable for any consequential or secondary damages, including but not limited to any expenses incurred as a result of moving, for any damage, destruction or loss. The guest, their family members and/or other occupants of the premises agree to release and indemnify the owner from and against all claims for damages and/or personal injuries to any person arising out of the use of subject premises, including interior and all exterior and common building areas, including decks, hot tub, stairs and all other common areas that occurred during the tenancy of the premises.

These claims include those that allegedly may fall under the Vacation Rental Act.

Tenant also agrees to defend owner and his agents from any lawsuit alleging damages and/or personal injury as a result of specific actions of tenant, their family members and/or occupants of the apartment that occurred during the guest’s stay. Guest shall not be entitled to any refund due to unfavorable weather, maintenance problems, area construction, early departure or disruption of utility services (including cable or internet) after occupancy. Guest agrees to be responsible for any repairs necessary due to their negligence. Owner reserves the right to enter and inspect premises with a reasonable notice to tenant. In the event of an ordered evacuation due to emergencies, hurricanes or other unforeseen circumstances, tenant is required by state law to evacuate property.

WRITTEN EXCEPTIONS – Any exceptions to the above mentioned policies must be approved by owner in writing in advance. We are not responsible for any accidents, injuries or illnesses that occur while on the premises or its facilities. The Homeowners are not responsible for the loss of personal belongings or valuables of the guest. By accepting this offer to stay at this house, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises. This agreement shall be governed by and interpreted in accordance with the laws of the State of North Carolina and shall be treated as though it was executed in State of North Carolina. Any action relating to this agreement shall only be instituted and prosecuted in courts in North Carolina.
