COZY TREEHOUSE CABINS, LLC RENTAL AGREEMENT
This rental agreement (“Agreement”) is entered into on ________, by and between Cozy Treehouse Cabins, LLC (“Owner”), and the undersigned individual(s) (collectively “Renter”) for good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged.
Short-Term Rental of Premises. The Owner rents to (Renter) _________________ the
premises located at 16331 Skinner Rd Logan Ohio 43138
and commonly known as Cozy Rental period is for the following time period (“Rental Period”):
Treehouse Cabins LLC.

Deposit. Deposit of 100% of TOTAL is due upon reservation.

Cancellation Policy: AIRBNB STRICT CANCELATION RULES APPLY TO ALL RENTALS.
Rules and Regulations: Renter agrees to abide by the following rules and regulations and understands, acknowledges and consents that a violation of any of the following is grounds for immediate eviction and forfeiture of all deposits, rents and fees as well as any additional damages to the Premises or to the Owner that may result from the violation:
4.1. Illegal Substances/Alcohol. Possession or use of illegal substances is prohibited. Under age possession or consumption of alcohol is prohibited.
4.2. Firearms/Fireworks. Discharging of firearms or use of any other weapon is prohibited. The use of fireworks is prohibited.
4.3. Smoking. Smoking is prohibited inside the cabin. A sterilization fee of $500.00 will be charged to the credit card on file for any violation of this rule.
4.4. Candles/Open Flame. The use of candles, inside or outside, is prohibited. Open sources of flame are prohibited.
4.5. Pets. Possession of pets or animals is prohibited. A sterilization fee of $500.00 will be charged to the credit card on file for any violation of this rule.
4.6. Children. All children must be under adult supervision at all times. Renter shall be responsible to compensate Owner for any damage to any property caused by the Renter’s or occupants’ children or children under the Renter’s or occupant’s care. Owner will not be responsible for any injuries to any children while enjoying your stay.
4.7. Renter Occupancy. Renter shall personally occupy the Premises for residential purposes only for duration of Rental Period unless Owner gives prior written and signed consent.
4.8. Occupants/Visitors/Invitees. Only those individuals who are identified as occupants in this Agreement are permitted on the Premises without the prior written and signed consent by Owner. Renter shall be responsible for the behavior and conduct of each of Renter’s occupants or visitors/invitees, shall be responsible for any violation of this Agreement by such occupants or visitors/invitees, and shall compensate Owner for any damage to property caused by such occupants or visitors/invitees.
4.9. Quiet Enjoyment. Renter will ensure outdoor noise and lights remain at a reasonable volume and intensity at all times such that neighboring renters and guests are not disturbed or offended and such that quiet enjoyment by neighboring properties is maintained.
4.10. Unlawful Purposes. Renter shall not use the Premises or its facilities, appliances, or equipment for any unintended or unlawful purpose or purposes deemed hazardous by the Owner's insurance company, and the Renter shall obey all laws, regulations, and rules of governmental agencies having jurisdiction over the Premises.
5. Maximum Occupancy.
5.1. _____1___ Cabin: Maximum of __7_ occupants.
If Renter exceeds the occupancy limit, the Renter shall instruct occupants to vacate so that the maximum occupancy is not exceeded. At the Owner’s sole discretion, the Renter shall be subject to immediate eviction and forfeiture of all deposits, rents and fees. Renter agrees that the Premises shall be used for residential purposes only and will be occupied only by those occupants identified in this Agreement. If Renter reports additional occupants before Arrival Date, the Owner, in its sole discretion, may prohibit such additional occupants or may charge an additional $25.00 per such occupant per night.
The Owner has video surveillance and still camera photos of the parking area and the entrances and periodically reviews the tapes. If Renter has guests/visitors/invitees on the Premises who are not identified in this Agreement or otherwise permitted by the prior written and signed consent of the Owner, then Owner reserves the right, at its sole discretion, to enforce the Rules and Regulations of this Agreement and to charge a fee of $100.00 per such occasion per night, and Renter acknowledges, gives consent and agrees, such amount may be charged to the credit card on file.
Assignment. Renter shall not assign any or all of the rights under this Agreement and shall not sublet this Agreement or any portion of it.
Liability/Indemnification. Renter acknowledges and agrees that the use of the Premises by Renter and Renter’s occupants or visitors/invitees is entirely at their own risk. If the Premises includes a hot tub or loft, Renter assumes all risk of use by Renter and Renter’s occupants or visitors/invitees together with assuming all risk of use of all facilities, appliances and equipment by Renter and Renter’s occupants or visitors/invitees. Renter assumes all risk for any damage that may occur to Renter’s or Renter’s occupants’ or visitors/invitees’ vehicles while on the Premises including ingress and egress to and from the Premises including, but not limited to, damage and/or tow as a result of inclement weather conditions. Renter agrees to indemnify, hold harmless and defend Owner, its employees and affiliates from any and all expenses, costs, damages, injuries, illnesses, suits, actions or liabilities of any nature that may arise by reason of the occupancy or use of the Premises and its facilities or by reason of a violation of this Agreement by Renter or Renter’s occupants or visitors/invitees. Owner is not responsible for lost or stolen items of Renter or Renter’s occupants or visitors/invitees.
Vacating Premises. Upon expiration of the Rental Period or earlier termination of the Agreement, Renter shall yield immediate possession to the Owner. Renter shall leave a forwarding address with the Owner. No refunds will be made for vacating prior to end of the Rental Period and no rents will be pro-rated. Refunds will not be made due to mechanical failures, inclement weather, war or acts of God.
Broom Clean Condition/Keys. Renter agrees to vacate premises in broom clean condition and in as good condition as when entering including cleaning and shelving dishes. Renter shall dispose of all trash in provided trash bags or receptacles. Renter shall be responsible for the cost of any excessive clearing required. Renter shall return all keys to Owner upon vacating Premises or otherwise the Owner shall charge the credit card on file for lock and key replacement.
Owner Entry/Remedies: In addition to all Owner rights and remedies available at law, equity, and contained in this Agreement, if Renter violates any provision of this Agreement or fails to perform any of Renter’s obligations herein, or if Renter or Renter’s occupants or visitors/invitees damage the Premises or rental facilities, Owner may, at Owner's election, at any time, enter into and secure possession of the Premises, or, at Owner’s election, may file an action in forcible entry and detainer and recover legal fees and damages accrued or accruing under this Agreement or arising out of any violation of this Agreement.
Damage to Premises: Liability for damage to the Premises caused by Renter or Renter’s guests/visitors/invitees is joint and several, and Owner may pursue its rights and remedies against the liable parties at its sole discretion. Owner may inspect the Premises upon Renter vacating the Premises or otherwise earlier termination of the Rental Period. Renter acknowledges, gives consent and agrees that any amounts due for such damages may be charged to the credit card on file.
Availability of Amenities: Owner will make reasonable efforts to ensure all amenities are in proper working order. However, some amenities may occasionally malfunction, including but not limited to electronics (TV/audio/video/satellite), telephone, internet service, recreational equipment, and appliances. If an outage of one of these amenities should occur, owner will make a reasonable effort to restore it to working order; however, no refunds will be provided for this reason.
Availability/Use of Hot Tub: If a hot tub is included with the Premises, Owner will make reasonable effort to ensure the hot tub is in working order. If a full drain and refill of the hot tub is necessary prior to the Rental Period to ensure safe water conditions, the hot tub may require several hours after Arrival Time to reach operating temperature. If a complete outage of the hot tub occurs during the Rental Period,No refunds will be provided for hot tub issues as they are beyond owners control. No children under the age of 16 are permitted in the hot tub without adult supervision. Renter’s and Renter’s occupants or visitors/invitees use of hot tub is at their own risk. Do not stand on hot tub covers. Replace cover on hot tub when not in use. Owner may inspect the hot tub on a daily basis. If the hot tub cover is damaged, Renter shall be charged $450.00 for replacement costs, which Renter acknowledges, gives consent and agrees, such amount may be charged to the credit card on file, likewise, Renter agrees to the charge of $50 to such credit card if the hot tub must be drained due to Renter’s or Renter’s occupants’ or visitors/invitees’ negligence.
Miscellaneous or extremely dirty water due to visitors negligence.
14.1. Arrival/Departure Time. Arrival Time is 3:00 P.M. or after and Departure Time is 11:00 A.M. Early arrival and late departure can be purchased in advance if available and will incur an additional charge. If Renter arrives early or departs late without a prior written, signed consent by Owner, Owner will charge Renter $50 per hour, or part of an hour, for such extra time, and Renter acknowledges, gives consent and agrees, that such amount may be charged to the credit card on file.
14.2. Housekeeping. There is no daily housekeeping service.
14.3. Owner Access. Renter shall permit Owner, its employees and agents access to the Premises for purposes of repair, alteration, improvements, inspections, confirming occupancy, investigating disturbances or damages, or other reasonable business purposes. Owner shall exercise its right of access in a reasonable manner.
14.4. Forum Selection. Any legal proceeding arising out of, relating to, or concerning this Agreement shall be brought in a state court of competent jurisdiction in Fairfield County, Ohio. Owner and Renter submit to the exclusive jurisdiction of that court for the purposes of any such proceeding and waive any claim that any legal proceeding brought in accordance with this paragraph has been brought in an inconvenient forum or that the venue of that proceeding is improper.
14.5. Governing Law. This Agreement is governed and must be construed by the laws of the State of Ohio, without regard to its conflict of laws provisions.
14.6. Entire Agreement. This Agreement contains the entire understanding and agreement between the Owner and the Renter and shall not be modified or superseded except upon express written consent of each of them.
