This beautiful 2 bedroom 2 bathroom Direct ocean front private residence is located at 101 20th Street, Miami Beach, FL 33139 otherwise known as The Setai. When you stay at the Setai Residences, you have access to the pool, beach, spa and gym. Guests also have access to valet at the normal hotel valet rate. You do not have access to room service or other hotel related amenities. Breathtaking views of the Ocean, the downtown skyline and the Intracoastal Waterway can be seen from this unit. The kitchen is fully equipped with utensils, plates, pots and pans and serving dishes. A coffee machine and a toaster are also provided. Wifi and Cable is included.

Bookings require an agreement to our rental policy. As well as an an additional security deposit.
We set up amenities at check in, however we do not replenish them during your stay.

This rental agreement is for a fully furnished apartment that includes water, electricity, air conditioning. Guest is aware that he does not have access to any hotel amenities, this includes but not limited to the following: pool, beach service, concierge, front desk, and restaurant.
At execution of this Lease the following charges are to be paid in full: (a) payment of the lease in the amount of _______ (b) payment of a checkout cleaning fee in the amount of $275.00 (c) all applicable taxes totaling 14% of the lease amount, _______. Total amount due _______.
The day prior to the commencement date of the lease Tenant will pay a security deposit in the amount of $1,500.00. This can be held as a pre-auth hold on a Credit Card. Failure to pay the security deposit on time may result in a forfeiture of the previous payments.
Legal Issues: Tenant agrees to supply additional monies for any additional usage of premises before extension of Lease for use. Any legal disputes arising for any reason in connection with this Lease will be disputed in Dade County, Florida. If any legal action is necessary under this lease the prevailing parties' reasonable legal fees and cost will be the sole responsibility of the losing party.
Non-Liability of Owner: Neither Owner nor any of its agents or employees shall have any liability to Guest or to Guest's agents, invitees, or guests for any damage, injury, loss, or claims based on or arising out of any cause whatsoever, including, without limitation, the following: interruption in the use of the Premises or any equipment or services therein; any accident or damage resulting from any use or operation by Owner, Guest, or any other person or entity of elevators or heating, cooling, electrical, sewerage, or plumbing equipment or apparatus; termination of this agreement by reason of damage to the premises or the building; fire, robbery, theft, vandalism, mysterious disappearance, or any other casualty; actions of any other tenant or occupancy of the condominium project or of any other person or entity.
Security Deposit: The security deposit will be refunded to Tenant after an inventory and inspection of premises is completed (Approximately five (5) business days after departure). This deposit may be used to repair any damage to the condition of the unit after commencement of the lease. Including, but not limited to the following:
Key: Each room key not returned will have an additional charge of $100.00 for each key from the security deposit. (This is what the Setai charges to replace the key). Please leave the keys on the kitchen counter upon departure.
Smoking: This unit is a nonsmoking unit. If any evidence of smoking is found inside the unit the Tenant will be charged $1,000.00 from the security deposit.
Pets: No animals are permitted on the premise without the prior written consent of Owner. If a pet is found on the Premise without the prior notification and consent of Owner, or if a pet of a different breed or size than is consented to by Owner is found on the Premises, Guest shall be in violation of this Agreement. In the event of such a violation, Owner may, without limitation on any other remedies available to Owner hereunder, at law, or in equity, elect to either: (i) terminate this Agreement and cause Guest and all occupants to vacate the Premises, in which event Guest shall forfeit all rental amounts paid; (ii) impose a surcharge against the Security Deposit in an amount equal to fifty percent (50%) of the full rental amount per pet to compensate Owner for such violation and the additional wear and tear on the Premise.
Events/Parties: No events/parties are allowed in the unit at any point during the lease term. Violation of this term will result in entire forfeit of the security deposit in addition to any damages caused by the licensee and their guests.
Use: The premises will be used exclusively as temporary lodging for no more than 4 person(s), including minors. (Please provide a list of the names of all intended occupants). If persons not identified in this agreement as a Guest or other occupants are found to be using the Premises, for each additional person a fee of twenty percent (20%) of the total rental amount will be automatically deducted from the Security Deposit. Additionally, if any laws or condominium, association rules regarding occupancy are broken, Guest will pay all fines associated with each such violation.(URL HIDDEN)Charge account: Tenant must open his/her own charge account with the Setai Resort for his/her expenses charged during his or her stay at the resort including but not limited to, food, parking, beverage, spa, beach and all services of any nature. Tenant has no authority to charge any expenses to any other account.
THE TENANT AGREES THAT ANY DAMAGES TO PROPERTY OR CONTENTS DURING THE TERM OF THE LEASE WILL RESULT IN MONIES BEING WITHHELD FROM SECURITY DEPOSIT OF THE UNIT AND TENANT WILL BE CHARGED AT REPLACEMENT VALUE. IN THE EVENT OF EXTRAORDINARY DAMAGES, THE TENANT SHALL BE HELD RESPONSIBLE AND HIS/HER CREDIT CARD WILL BE CHARGED ACCORDINGLY.
Housekeeping: is not included in room rate. Daily housekeeping is $135.00 per visit and will include cleaning the unit and fresh towels. Random cleaning is $200.00 including linen change. When you schedule housekeeping we will ask you for your preferred time. You may cancel housekeeping for no charge with a 12 hour notice. If you cancel housekeeping last minute you will still be charged. If you cancel housekeeping last minute you will still be charged. If housekeeping is denied access for a period of longer than 30 minutes a $40.00 wait fee will be applied.

Cancellation/No show: Final Sale. No Refunds
Parking: valet at valet rate.
Payment: Our owners are not set to process Credit Cards therefore we prefer payment via wire transfer. However, we have set Luxury Rentals up to process Credit Cards for the convenience of our guest. If you choose to pay with a Credit Card there will be a 4% courtesy fee added to the total amount charged.
All guest must comply with all applicable laws, regulations, ordinances and rules, including, without limitation, the rules of the Condominium Association. In addition, any unreasonable disturbance to any neighbors or any actions that would constitute a breach of peace or nuisance is unacceptable. If either of the above mentioned occur and is not rectified within one warning from the hotel, monies will be deducted from your deposit. The amount is determined by the landlord.
There will be a check out fee of $275.00 charged. This is to cover the final clean and inspection of the unit. This fee is non-negotiable. If excessive cleaning is determined by the housekeeping company that is beyond a “normal" final clean, additional funds will be deducted from the deposit.
This unit is currently on the market for sale. We may from time to time have to show the unit. We will provide a 24 hour notice via email if indeed we do have a potential client. In the event this unit does sell from now till your arrival date and the new owner wants to take ownership prior to your arrival date, and he does not wish to inherit the rental, then we would need to cancel the rental and provide a full refund
