The space
The entire exterior of the home is constructed of white pine logs. You can feel the peace and energy these trees continue to emit. The Great Room has a fireplace and a vaulted ceiling. Sitting in that room is breathtaking. Your Host, Cheryl, says the best view is in the chair near the Tiffany lamp.

The kitchen is stocked with everything you will need (including condiments and spices).

The bedrooms are spacious and equipped with extra blankets and pillows. They also have a heating blanket on the bed. The closet has plenty of hangers and a rack to place your luggage. Each bedroom has a TV that has WiFi connection to (Hulu, Netflix, Prime Video, and more).

Throughout the house, you will have a desk with supplies. In the bedrooms, you have plenty of clothes storage in the dresser and nightstands.

All three bathrooms are equipped with towels, shampoo, conditioner, body wash, lotion, hand soap, and a hair dryer.

In the basement, you will find the Game Room, Laundry Room, and a bathroom.

Outside is a large open deck with a deck tower heater. If the Host is on-site, she will light it for you. Otherwise, please do not use it.

The covered front porch offers a nice place to sit on rainy days.

There is plenty of free parking.

When the Host is on site, she may have her two cats with her.

You are free to use all three bedrooms, the loft area, great room and dining area, kitchen, three bathrooms, game room, laundry room, large open deck, covered porch, and the entire 5 acres.

The Hosts operate short-term rentals through their business, Pax Incepta LLC. Before booking a stay with them, you must read and agree to the following terms and conditions of the Rental Agreement. By booking your reservation, you agree that you have read and agree to the entirety of this agreement and have agreed to have everyone in your party do the same.

This Vacation Rental Agreement, including the House Rules and Check-In / Check-Out procedures, together represent the contract (the “Agreement”) as the legally binding agreement made and entered into as of the Reservation Date by and between the booking guest (the “Guest” or “Tenant”) and the property owner (the “Owner” or “Landlord”) including the Owner’s rental agent, PAX INCEPTA LLC (the “Rental Agent” or “Agent”), and the booking service which may include the Rental Agent and/or other online booking service (the “Booking Service”) pursuant to which the Guest has agreed to rent one or more of the residence(s) described
below (the “Property”), for the duration of the Rental Term for the Total Rental Amount including Fees and Taxes. Specifically, the “Property” refers to any property owned and/or managed by the Rental Agent.

ACCEPTANCE OF AGREEMENT, RULES & RESPONSIBILITIES – GUEST CONFIRMS ACCEPTANCE OF ALL TERMS OF THIS AGREEMENT, INCLUDING HOUSE RULES AND CHECK-IN / CHECK-OUT PROCEDURES. LIKEWISE, BOOKING GUEST CONFIRMS THEY HAVE ADVISED ALL MEMBERS OF THEIR PARTY AND CONFIRMS THEY ALSO AGREE TO ALL SAID TERMS OF THE AGREEMENT, AND THE BOOKING GUEST ACCEPTS COMPLETE RESPONSIBILITY AND SOLE LIABILITY FOR ANY VIOLATIONS, DAMAGES, LIABILITIES, INJURIES, OR DEATH EXPERIENCED BY GUEST AND/OR MEMBERS OF THE BOOKING GUEST PARTY.

VIDEO SECURITY Our Video Security monitors exterior access points only. Cameras are monitoring the front porch and rear parking area near the garage. They are turned on during Check-In and Check-Out times, and if we receive a report from neighbors that there may be a problem occurring at the location. The reason for having camera monitoring is so the Host can ensure the Check-In and Check-Out process is being executed as agreed upon. Also, we want to be able to view weather conditions to determine if we need to arrange for snow removal. If you would like to have the camera monitoring turned on while you are there, text the Host with your request. The ADT alarm system is disarmed and will remain so during your entire stay.

CHECK-OUT INSTRUCTIONS

Housekeeping will likely be there at 10 am. Contact us at least 24 hours in advance if other times are needed. We will try to accommodate if there are no other conflicts with housekeeping.

CHECK-OUT RESPONSIBILITIES
1. Gather used towels and place them in the tub.
2. Leave used bed linens on beds unmade.
3. Deposit trash in the black garbage containers located in the Laundry Room. Please do not leave trash outside; it will attract unwanted wildlife.
4. Turn off all lights (except the one in the living room, which is labeled to leave on).
5. Make sure the oven and coffee maker is off, fans are turned off, heating blankets are turned off, and the two ceramic heating units in the living room are off (one is by the stairs, the other is next to the fireplace).
6. Make sure all windows are shut and lock tightly. Lock all doors. Make sure the sliding glass doors are locked. The one near the dining room table has a lock on the floor (depress it with your foot). They have faulty locks...so instead, place the rods into the tracks to prevent the door from being opened. Lock the basement door. Exit out via the front door and lock the smart lock this way...press and hold any number. You will see a red check mark. It is locked.
7. Remove all food items you brought with you. Check frig, oven, and microwave.

OCCUPANCY LIMIT
No more than 9 people (unless preapproved). Booking Guest must be over 25 years old.

DAMAGE INSPECTION Do this for your own protection!
WITHIN 24 HOURS of first entry to our home, the Guest must report in writing with photos any damage they see. Otherwise, you may be charged for it. Be sure you’ve read and understand the ‘Pet Policy’ and ‘Damage Clause’ of our Rental Agreement.

SEPTIC TANK CONSIDERATIONS
We have a septic tank to handle our wastewater. To keep the tank running well, please follow these instructions:
• Toilets – FLUSH ONLY TOILET PAPER. DO NOT FLUSH ANYTHING ELSE. This means you cannot flush baby wipes, tampons, Kleenex tissue, etc. ONLY TOILET PAPER PLEASE!
• Kitchen Sinks – When doing dishes, wipe all food and grease into the garbage before rinsing them off. WIPE OFF AS MUCH GREASE AND FOOD AS POSSIBLE.
• NO COFFEE GROUNDS DOWN DRAIN
• NO FOOD DOWN DRAIN

DOUBLE OVEN
The top oven is used for the storage of pots and pans ONLY. DO NOT USE THE TOP OVEN.
The bottom oven tends to run a bit hot. You may need to adjust the time or temperature as needed. See the notes located on the double oven to determine which control knobs to use for the bottom oven.

THERMOSTAT The house thermostat is located on the wall next to the door leading to the basement. It is the top (digital) one. The System Setting will be set at HEAT during the winter months and COOL during the summer months. If this is not the case, contact Host. She will advise you over the phone what you must do to set the thermostat correctly. Please do not attempt to adjust the settings without the instruction of the host.

NO LOUD ACTIVITIES
PLEASE BE COURTEOUS & RESPECT OUR NEIGHBORS! This is a quiet residential neighborhood meant for peaceful enjoyment by all.

NO CLIMBING
Keep off the railings around the loft and around the deck. Do not climb trees. Stay far away from trees that have fallen in the woods and are leaning on other trees. This could be very dangerous as the trees could fall and cause injury.

ADULT SUPERVISION
Children should not be in the loft, recreation room, or in the woods unattended. An adult must be with them.

PARKING AND DRIVEWAY
There is room to park six cars easily. Two near the house, two near the shed, and two at the top of the driveway (to the right) just as it turns towards the house.
• Never block road access for our neighbors and/or service trucks.
• No trailers, RVs, or vehicles larger than a normal-sized car or minivan allowed.
• The driveway is a long gravel slope. 4 Wheel Drive vehicles do well getting up it. Other vehicles will have difficulty during snow-covered days. We will do our best to keep the driveway plowed on snowy days. The Guest will not hold the Rental Agent responsible for any damage done to their vehicle while it is on the Rental Agent’s property. This includes damage caused by slippery conditions on the driveway, such as the Guest’s vehicle sliding off the driveway over the hill or into a ditch. 4-Wheel Drive vehicles are recommended, especially on snow covered days (even if the driveway is plowed). Be advised ...DRIVE UP AT YOUR OWN RISK. If you get stuck you will pay the cost of getting towed out. If you drive up, use a CONTROLLED STEADY PACE, and DO NOT LET UP ON THAT PACE. KEEP THE MOMENTUM GOING until you reach the top of the driveway as it turns to the left onto a level area. Signs will guide you along the way. Alternatively, you can park in the area at the bottom of the driveway (off to the right) in the designated parking area, and walk up. There is room for two cars in this area. In the Laundry Room is a sled you can use to pull up your luggage. We arrange to have the driveway plowed, but, it can still be a challenge. We want you to be safe. So, please use caution and follow these recommendations. Remember, if you are hesitant to drive up, park in the area provided at the bottom of the driveway.
• PLEASE DO NOT PARK ON THE ROAD.

WINTER WEATHER CONDITIONS
Winter guests should monitor the weather reports. If you see a snow/ice alert, be sure you are prepared in case you have problems with access or get snowed in. We will make every effort to have the driveway plowed asap. We plow until we see gravel popping through the snow. When you arrive, if you see there is a lot of snow on the driveway, we recommend you don’t try to drive up (unless you have 4WD and are sure you can make it). When driving downhill, grab onto the gravel as you drive, as this will give you traction. Don’t stand on the brakes as you go downhill (we know it’s tempting). We find it best to put the car in neutral and gently let it roll downhill, applying the brakes ever so gently so as not to start sliding off.

Food, Supplies, Batteries charged
Be sure you are prepared with what you need in the event you get snowed in.
Power Outage - Call the Host
There should be a camping lights in the wooden cabinet near the stairs in the great room.
Porches / Driveway / Road Surfaces – Be very careful!
If you can’t walk on it, DON’T drive on it! (4WD will NOT help)
If there is snow or ice on the road, don't try to drive on it until it melts off.
It usually melts within a day or so, but sometimes it can last longer.
Snow Shovels / Ash Barrels / Buckets
There is an ash bucket & snow shovel in the Laundry Room.
Ash works better than salt as it doesn’t turn the dirt to mud.
Alternate Parking
This is what we do if the weather is bad. If you are concerned about being able to get up the driveway, you can park your car at the bottom of the driveway and walk up.
Sled For Hauling Luggage / Groceries
We have a sled located in the laundry room. It can be used to load up groceries or personal items and take them to and from your car (if you use the Alternate Parking).
Be safe, and feel free to call the Host if you have questions.

OUTDOOR FIRES
• Outdoor fires in the woods are not allowed unless the Host is there to supervise (as will be the case in room-only rentals). In order to ensure the safety of the state park and surrounding properties outdoor fires can only be supervised by the Host or her designated person. This responsibility is taken very seriously and can rest only on the shoulders of the Host.
• Never take wood from the property.

FIREPLACE
• No wood fires in the fireplace.
• We know that having a fire in the fireplace adds a lot to the ambience of the home. That is why we have provided our guests with a fireplace insert that is powered by electricity and creates a beautiful “fake” fire. It even gives off heat. To operate this fireplace, simply flick the switch to ON. Make sure you turn it off when you go to bed or leave the house.

PROPANE HEATER ON DECK
There is a propane heater tower on the deck. For your safety, it can only be used if the Host is present to supervise. Please do not use it without the Host being present.

PET POLICY Sorry…No Pets
We love dogs and know how important they are as family members. That said, we’ve learned the hard way that even well-behaved dogs can become stressed in unfamiliar situations. So, to protect our property, Guest agrees to be bound by strict adherence to this Pet Policy. Our home is equipped to safely host service dogs only, not other types of service animals.
We allow only certified service dogs. No other pets are allowed.
• There is no fee for a certified service dog. You may have up to two service dogs. All service dogs must be pre-approved.
• Dogs MUST be friendly, well-behaved, NOT allowed on the furniture, NEVER left alone indoors (unless crate trained), and ALWAYS on leash outdoors. Dispose of all pet waste with your trash (not down toilets).
• Guest agrees to be solely liable and financially responsible for any pet damage or injury to people or property and to legally defend and hold harmless the property owner and/or their representatives against any legal actions or claims regarding any pet-related damage or injury.

NO SMOKING NOR VAPING INDOORS
• All smoking materials must be disposed of in the provided containers that are located on the deck and on the covered porch.
• No smoking in the yard or in the woods.

TRASH REMOVAL
Please do not put liquids in the trash can. All trash must be removed by you. Dispose of trash inside plastic garbage bags located under the kitchen sink. Tie them up and place them in the covered black garbage cans in the laundry room.
DO NOT PLACE TRASH OUTSIDE!! THIS WILL ATTRACT UNWANTED WILDLIFE. Also, for this same reason, do not leave food of any kind outside.

POWER OUTAGE OCCURRENCE
The entire house runs on electric power. Occasionally, the power goes out due to something happening along the power grid of the electric company. The Guest understands that this possible minor inconvenience may occur and accepts that this could happen. We have a generator that will run the house as normally as possible during the outage. Things that cannot be used during an outage and while the generator is supplying power are oven, cooktop, washer/dryer, dishwasher, and limited hot water. So, showers should be postponed until the power is restored.
The Guest will not hold the Rental Agent responsible in any way for any inconvenience, harm, or injury incurred upon them or their guests as a direct result of the power outage.
If the generator is not used during the power outage, the Rental Agent will reimburse the Guest a sum that correlates to the number of hours the power was out. The calculation will be (Total room rate, divided by the total number of hours rented, multiplied by the total number of hours of the outage).

WHAT TO DO IF THE POWER GOES OUT:
• If power goes out, contact the Host. She will contact the power company to get an update on when power will be restored. Normally it's only for a couple of hours, but, has been known to go out longer. The Host will arrange for someone to come and hook up the generator and remove it once the power company restores the power. You will have some limitations as to what you can and cannot do while the generator is hooked up (listed below).
• Emergency Lights are in the wooden cabinet in the great room by the stairs that lead to the loft.
* During an outage there will be no heat or air conditioning. During warm months you can open windows. During cold months there are heaters in the great room retaining heat, but, depending on the length of the outage, you may have to wear extra layers.
*. During an outage DO NOT USE THE OVEN OR STOVE TOP because the generator cannot support that wattage. To cook, you can use the two burner electric hot plate that is stored in the top oven. Likewise, you can use the propane powered cooking stove that is located in the basement. Use it only outside please.
*. During an outage you cannot take long showers as there will be a limited amount of hot water available in the hot water tank. YOU CANNOT DO LAUNDRY.
*. Things you CAN do during a power outage are:
Use water - The water pump will operate. You can flush toilettes, use water from the sinks (hot water will be limited). If you take a shower, do it quickly as the hot water in the hot water tank will be limited.
Refrigerator - It will continue to stay working. Your food is safe.
Power outlets - Anything plugged into a power outlet will operate. Things like lights, TV, computers, chargers, etc will all work just fine.
Internet access - You will continue to have access to the internet.
LIMIT USE - Since everything will be running on the generator, limit the use (i.e. turn off lights not being used, limit the number of TVs being used. In other words, the less drain on the generator the better.)

OWNER’S PROPERTY
Throughout the house, you will see a few notes indicating something as the Owner’s Property. Please be respectful of these areas and do not disturb them. Thanks.

WHITE LABEL NOTES and OTHER INSTRUCTIONS
You will find several white labels throughout the house that will be helpful to you. They will indicate things that will make your stay easy and comfortable. Watch for them and read them. You will also find several “How To” type notes around the premises to assist you in things like operating the various TV remote controls, lighting the propane deck tower heater, turning on the fireplace (electric switch), operating the dishwasher, brewing a cup of coffee from the single cup brewer, etc.

ALL GUESTS MUST AGREE AND ACCEPT FULL RESPONSIBILITY TO COMPLY WITH ALL RULES AND CONDITIONS OF OUR RENTAL AGREEMENT

PAYMENT:
Payments: Full or partial payment at the time of booking the reservation indicates the Guest's acceptance of the terms of this Agreement of the Property. All deposits and payments towards the rental amount, including housekeeping, pet, taxes, booking fees, and security deposits, are collected by the Booking Service or Agent at the time of booking and distributed by the Booking Service or Agent in accordance with their payment policies.

Security Deposits: Security deposits are collected and refunded, on Owner approval, by the Booking Service in accordance with their refund policies. Typically, Security Deposit refunds are initiated about 7 days or so after checkout. Guest agrees refunds are subject to compliance with all the terms of this Rental Agreement and refunded in full, or in part, at the sole discretion of the Owner. Examples of violations for which refunds may be withheld could include, but are not limited to: pet hair on furniture, pets left alone indoors, pets not on leash outdoors, furniture damage, trash not removed, and an inaccurate number of guests or pets not reported. Guest understands and agrees that if the Security Deposit does not cover the cost of penalties, repairs, or replacement as determined by the Owner, the Guest will reimburse the Owner for those additional costs as described in the Damage Clause of this Rental Agreement.

CANCELLATION POLICY:
This shall be the default Cancellation Policy. If any provisions of the online Booking Service Cancellation Policy conflict with any of the provisions of this policy, only those provisions of the online Booking Service policy shall prevail without negating any of the other provisions of this Cancellation Policy. Specifically about the ‘more than 16 nights’ section of this policy, unless the online Booking Service specifically prohibits this policy, the ‘more than 16 nights’ section of this policy shall prevail by default and in cases where it may seem to conflict with the online Booking Service policy if the Guest and Rental Agent have further confirmed so in writing via text, email or website message system this policy shall override the online Booking Service Cancellation Policy.

RESERVATIONS – 16 Nights or less
> 100% refund for cancellations more than 60 days before check-in date.
> 50% refund for cancellations more than 30 days before check-in date.
> No refund for cancellations 30 days or less before check-in date.

RESERVATIONS – more than 16 Nights
> 100% refund for cancellations more than 90 days before check-in date.
> 50% refund for cancellations more than 60 days before check-in date.
> No refund for cancellations 60 days or less before check-in date.


CONDITION AND USE OF PROPERTY
The Property is provided in “as is” condition. Rental Agent shall use its best efforts to ensure the operation of all amenities in the Property, such as internet access, TV access, electric power supply, appliances, and electric fireplace, as applicable. Rental Agent shall not be held responsible for such item’s failure to work, but will make every effort to correct any issues as reported as quickly as possible. Guest acknowledges that use of amenities may be potentially dangerous, particularly for children, and such use is at the Guest’s own risk.

Guest shall use the Property for residential purposes only and in a careful manner to prevent any damage or loss to the Property and always keep the Property in clean and sanitary condition. Guest and members of the Guest party shall comply with all House Rules, refrain from loud noise, and shall not disturb, annoy, endanger, or inconvenience neighbors, nor shall Guest use the Property for any immoral, offensive, or unlawful purposes, nor violate any law, association rules, or ordinance, nor commit waste or nuisance on or about the Property.

DAMAGE CLAUSE
WITHIN 24 HOURS of first entry to our home, the Guest must report in writing with photos any damage, or they may be charged for it. The Guest accepts sole responsibility and financial liability for everyone in their party. Guest agrees to forfeit up to the full amount of their Security Deposit as a penalty for non-compliance with any conditions of our Rental Agreement, including House Rules and Pet Policy, and will pay the total cost for repairs or total replacement costs for damages as determined at the sole discretion of the property owner.

DEFAULT
If the Guest should fail to comply with the conditions and obligations of this Agreement, the Guest shall immediately surrender the Property on demand by the Rental Agent, remove all the Guest’s property and belongings, and leave the Property in good order and free of damage. No refund of any portion of the Total Rental Fee shall be made, and if legal action is necessary, the prevailing party shall be entitled to reimbursement from the other party for all costs.

Expedited Evictions - Any Tenant who leases residential property subject to a vacation rental agreement for 30 days or less may be evicted and removed from the property in an expedited eviction proceeding brought by the Landlord, their Agent, or real estate broker as agent for the Landlord, if the Tenant does one of the following:
(1) Holds over possession after his or her tenancy has expired.
(2) Has committed a material breach of the terms of the vacation rental agreement that, according to the terms of the agreement, results in the termination of his or her tenancy.
(3) Fails to pay rent as required by the agreement.
(4) Has obtained possession of the property by fraud or misrepresentation

ENTRY AND INSPECTION
Rental Agent reserves the right to enter the Property at reasonable times and with reasonable advance notice for the purposes of making repairs, property maintenance, inspecting the Property, or showing the Property to prospective purchasers, renters, or other authorized persons. If the Rental Agent has a reasonable belief that there is imminent danger to any person or property, the Rental Agent may enter the Property without advance notice.

UNAVAILABILITY OF PROPERTY
In the event the Property is not available for use during the Rental Term due to reasons, events, or circumstances beyond the control of Rental Agent, Rental Agent shall immediately return all payments made by the Guest, whereupon this Agreement shall be terminated and Guest and Rental Agent shall have no further obligations or liabilities in any manner about this Agreement.

Transfer Of Property - Upon termination of the landlord's interest in the residential property subject to a vacation rental agreement, whether by sale, assignment, death, appointment of receiver or otherwise, the landlord or the landlord's agent, or the real estate broker, shall, within 30 days, transfer all advance rent paid by the tenant, and the portion of any fees remaining after any lawful deductions made under G.S. 42A-16, to the landlord's successor in interest and thereafter notify the tenant by mail of such transfer and of the transferee's name and address. If a real estate broker is holding advanced rents paid by the tenant pursuant to a vacation rental agreement at the time of the termination of the landlord's interest, the real estate broker may deduct from the advanced rents transferred to the landlord's successor in interest any management fee earned by the real estate broker before the transfer. The written agency agreement between the landlord and the real estate broker shall govern when the fee has been earned. If the real estate broker deducts an earned management fee from the advanced rents, the landlord shall be responsible to the landlord's successor in interest for the amount deducted. For vacation rentals that end more than 180 days after the recording of the interest of the landlord's successor in interest, unless the landlord's successor in interest has agreed in writing to honor the vacation rental agreement, the landlord or the landlord's agent, or the real estate broker, shall, within 30 days, transfer all advance rent paid by the tenant, and the portion of any fees remaining after any lawful deductions made to the tenant. Compliance with this subsection shall relieve the landlord or real estate broker of further liability with respect to any payment of rent or fees. Funds held as a security deposit shall be disbursed in accordance with the refund policy of the booking service.

RISK OF LOSS AND INDEMNIFICATION
GUEST, AND ALL MEMBERS OF GUEST PARTY, AGREE THAT ALL PERSONAL PROPERTY, FURNISHINGS, PERSONAL AFFECTS, AND OTHER ITEMS BROUGHT INTO THE PROPERTY BY GUEST OR THEIR PERMITTED GUESTS AND VISITORS SHALL BE AT THE SOLE RISK OF GUEST ABOUT ANY THEFT, DAMAGE, DESTRUCTION, OR OTHER LOSS, AND RENTAL AGENT SHALL NOT BE RESPONSIBLE OR LIABLE FOR ANY REASON WHATSOEVER.

GUEST, AND ALL MEMBERS OF GUEST PARTY, HEREBY COVENANTS AND AGREES TO INDEMNIFY AND HOLD HARMLESS RENTAL AGENT AND THEIR AGENTS, OWNERS, SUCCESSORS, EMPLOYEES AND CONTRACTORS FROM AND AGAINST ANY COSTS, DAMAGES, LIABILITIES, CLAIMS, LEGAL FEES AND OTHER ACTIONS FOR ANY DAMAGES, COSTS, ATTORNEYS FEES INCURRED BY GUEST, PERMITTED GUESTS, VISITORS OR AGENTS, REPRESENTATIVES OR SUCCESSORS OF GUEST DUE TO ANY CLAIMS RELATING TO DESTRUCTION OF PROPERTY OR INJURY TO PERSONS OR LOSS OF LIFE SUSTAINED BY GUEST OR FAMILY AND VISITORS OF GUEST IN OR ABOUT THE PROPERTY AND GUEST EXPRESSLY AGREES TO SAVE AND HOLD RENTAL AGENT HARMLESS IN ALL SUCH CASES.

GUEST, AND ALL MEMBERS OF GUEST PARTY, HEREBY WAIVE AND RELEASE ANY CLAIMS AGAINST RENTAL AGENT, THE PROPERTY OWNER, AND THEIR SUCCESSORS, ASSIGNS, EMPLOYEES, OR REPRESENTATIVES, OFFICIALLY OR OTHERWISE, FOR ANY INJURIES OR DEATH THAT MAY BE SUSTAINED BY GUEST ON OR NEAR OR ADJACENT TO THE PROPERTY, INCLUDING ANY COMMON FACILITIES, ACTIVITIES, OR AMENITIES. GUEST AGREES TO USE ANY SUCH FACILITIES OR AMENITIES ENTIRELY AT THE GUEST’S OWN INITIATIVE, RISK, AND RESPONSIBILITY.

GENERAL PROVISIONS
Mandatory Evacuations - If State or local authorities, acting pursuant to Pennsylvania Statutes Title 35 Pa.C.S.A. Health and Safety § 7301 General authority of Governor, order a mandatory evacuation of an area that includes the residential property subject to a vacation rental, the tenant under the vacation rental agreement, whether in possession of the property or not, shall comply with the evacuation order. The tenant shall be entitled to a refund from the landlord of the rent, taxes, and any other payments made by the tenant pursuant to the vacation rental agreement as a condition of the tenant's right to occupy the property, prorated for each night that the tenant is unable to occupy the property because of the mandatory evacuation order.
This Agreement contains the entire agreement between the parties about the rental of the Property, and any changes, amendments, or modifications hereof shall be void unless the same are in writing and signed by both the Guest and the Rental Agent. The words “Rental Agent” and “Guest” shall include their respective property owners, heirs, successors, and representatives. The waiver or failure to enforce any breach or provision of this Agreement shall not be considered a waiver of that or any other provision in any subsequent breach thereof. If any provision herein is held invalid, the remainder of the Agreement shall not be affected. Any notice required to be given under this Agreement shall be in writing and sent to the contact information included herein.
