Kohola (Humpback Whales)
Humpback whales visit the waters along Turtle Bay Resort beginning each year in November and can be seen through April, with the peak of the season being from January to March. Turtle Bay Resort is located in the Hawaiian Islands Humpback Whale National Marine Sanctuary which encompasses approximately 1,218 square nautical miles of coastal and ocean waters around the main Hawaiian Islands. Turtle Bay is pleased to work with the Hawaiian Islands Humpback Whale National Marine Sanctuary, which protects the winter breeding, calving and nursing range of the largest remaining population of the endangered humpback whale.
Honu (Sea Turtle)
The two types of sea turtles most frequently observed at Turtle Bay are the green sea turtle and the hawksbill sea turtle. The green sea turtle is listed as a threatened species under federal and state law. Hawaiian green sea turtles have shown a good population recovery in recent years, although they are still plagued with a papilloma virus that causes disfiguring tumors. Hawksbill sea turtles are sighted much less frequently than the greens. Honu are spotted on every kayak tour. After all it isn't called Turtle Bay for nothing.
‘Ilio-holo-i-ka-uaua (Monk Seal)
Hawaiian monk seals are among the most critically endangered mammals in the world. Only about 1,200 seals are alive today. There is a small and growing population of seals in the main Hawaiian Islands and a 2005 survey observed 76 seals here. Monk seals frequently haul-out on our shorelines to rest and molt. They may look sick, but they are usually perfectly healthy. Beaches at Turtle Bay are isolated from large human populations and are a favorite haul-out location for these critically endangered Hawaiian Monk Seals. Turtle Bay Resort takes extra precausions to make sure these wonderfull animals are left alone and are treated with respect.
Whales and dolphins are highly perceptive of their surrounding environment. Dolphins are often found playing with inanimate objects, both in captivity and in the wild. They have frequently been seen using plastic bags, pieces of seaweed or any other debris as objects to toss around, drag off one’s pectoral fins or flukes, and exchange with other members. Such observations are suggestive of playing games similar to our version of “tag” or “catch”. Play in animals is a way of learning or practicing important life skills.

This Rental Agreement and Contract (the “Agreement”) is a legally binding agreement made and entered into as of the Reservation Date written below by and between the undersigned person(s) or company (the “Guest”) and the undersigned owner, manager or agent (“Rental Agent”), pursuant to which the Guest has agreed to rent the residence described below (the “Property”), for the duration of the Rental Term for the Total Rental Fee and other good and valuable consideration as described herein.
Guest agrees that no more than [Max Guests] persons shall be permitted on the Property at any time during the Rental Term, all of whom shall comply with the conditions and restrictions imposed upon Guest under this Agreement.
CONDITION AND USE OF PROPERTY
The Property is provided in “as is” condition. Rental Agent shall use its best efforts to ensure the operation of all amenities in the Property, such as internet access, satellite or cable TV access or hot tubs, fireplaces as applicable. Rental Agent shall not be held responsible for such items failure to work, but will make every effort to correct any issues as reported as quickly as possible. Guest acknowledges that use of amenities such as hot tubs, pools, spas, fireplaces, decks, and the like may be potentially dangerous and involve potential risks if improperly used, particularly with regard to children and such use is at the Guest’s own risk.
Guest shall use the Property for residential purposes only and in a careful manner to prevent any damage or loss to the Property and keep the Property in clean and sanitary condition at all times. Guest and any additional permitted guests shall refrain from loud noise and shall not disturb, annoy, endanger, or inconvenience neighbors, nor shall Guest use the Property for any immoral, offensive or unlawful purposes, nor violate any law, association rules or ordinance, nor commit waste or nuisance on or about the Property.
If Guest should fail to comply with the conditions and obligations of this Agreement, Guest shall surrender the Property, remove all Guest’s property and belongings and leave the Property in good order and free of damage. No refund of any portion of the Total Rental Fee shall be made and if any legal action is necessary, the prevailing party shall be entitled to reimbursement from the other party for all costs incurred.
ASSIGNMENT OR SUBLEASE
Guest shall not assign or sublease the Property or permit the use of any portion of the Property by other persons who are not family members or guests of the Guest and included within the number of and as permitted occupants under this Agreement.
RISK OF LOSS AND INDEMNIFICATION
Guest agrees that all personal property, furnishings, personal affects and other items brought into the Property by Guest or their permitted guests and visitors shall be at the sole risk of Guest with regard to any theft, damage, destruction or other loss and Rental Agent shall not be responsible or liable for any reason whatsoever.
Guest hereby covenants and agrees to indemnify and hold harmless Rental Agent and their agents, owners, successors, employees and contractors from and against any costs, damages, liabilities, claims, legal fees and other actions for any damages, costs, attorneys fees incurred by Guest, permitted guests, visitors or agents, representatives or successors of Guest due to any claims relating to destruction of property or injury to persons or loss of life sustained by Guest or family and visitors of Guest in or about the Property and Guest expressly agrees to save and hold Rental Agent harmless in all such cases.
Guest hereby waives and releases any claims against Rental Agent, the Property owner and their successors, assigns, employees or representatives, officially or otherwise, for any injuries or death that may be sustained by Guest on or near or adjacent to the Property, including any common facilities, activities or amenities. Guest agrees to use any such facilities or amenities entirely at the Guest’s own initiative, risk and responsibility.
ENTRY AND INSPECTION
Rental Agent reserves the right to enter the Property at reasonable times and with reasonable advance notice for the purposes of inspecting the Property or showing the Property to prospective purchasers, renters or other authorized persons. If Rental Agent has a reasonable belief that there is imminent danger to any person or property, Rental Agent may enter the Property without advance notice.
UNAVAILABILITY OF PROPERTY
In the event the Property is not available for use during the Rental Term due to reasons, events or circumstances beyond the control of Rental Agent, Rental Agent will apply due diligence and good faith efforts to locate a replacement property that equals or exceeds the Property with respect to occupancy capacity, location and value that meets the reasonable satisfaction of the Guest. If such replacement property cannot be found and made available, Rental Agent shall immediately return all payments made by the Guest, whereupon this Agreement shall be terminated and Guest and Rental Agent shall have no further obligations or liabilities in any manner pertaining to this Agreement.
ADDITIONAL TERMS TO THE RENAL AGREEMENT
In addition to the standard terms included herein, Guest acknowledges and agrees that the following additional terms and conditions apply to the Guest’s rental of the Property:
This Agreement contains the entire agreement between the parties with regard to the rental of the Property, and any changes, amendments or modifications hereof shall be void unless the same are in writing and signed by both the Guest and the Rental Agent. This Agreement shall be governed by the laws of the State of New York, Hawaii and California. The words “Rental Agent” and “Guest” shall include their respective heirs, successors, representatives. The waiver or failure to enforce any breach or provision of this Agreement shall not be considered a waver of that or any other provision in any subsequent breach thereof. If any provision herein is held invalid, the remainder of the Agreement shall not be affected. Any notice required to be given under this Agreement shall be in writing and sent to the contact information included herein. This Agreement may be signed in one or more counterparts, each of which is an original, but taken together constitute one in the same instrument. Execution of a digital signature shall be deemed a valid signature.

3. Pets are not permitted in rental units under any conditions.
4. Sand is to be removed prior to entering the unit. There is a shower at the pool or toweling off is suffice.
5. No noise after 10 pm as per city rules. 6. No excessive drinking on premise. Casual drinking for 21 older only. Under age drinking will waive your right of stay and forfeit your rental costs.
7. DAMAGE/RESERVATION DEPOSIT- A damage issues will be held directly by Airbnb and all final results will be done through their booking system. Tenants are held liable for all damages and units left in poor condition.

1.PAYMENT - An advance payment equal to 50% of the rental rate is required at booking. The advance payment will be applied toward the unit rent. The BALANCE OF RENT is due fourteen (14) days before your arrival date.
2.CANCELLATIONS - A thirty (30) day notice is required for cancellation. Cancellations that are made more than thirty (30) days prior to the arrival date will incur no penalty. Cancellations or changes that result in a shortened stay, that are made within 30 days of the arrival date, forfeit the 50% rental payment and 50% of damage/reservation deposit. Cancellation or early departure does not warrant any refund of rent or deposit.
3.MAXIMUM OCCUPANCY- The maximum number of guests per condominium is limited to six (6) persons. An additional charge or $20.00 per person per night for guests in addition to four (4) will be assessed.
4.INCLUSIVE FEES - Rates include a one-time linen-towel setup. Amenity fees are included in the rental rate.

6.RATE CHANGES - Rates subject to change without notice. But once booked your rate is honored.
7.FALSIFIED RESERVATIONS - Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to check-in.
8.WRITTEN EXCEPTIONS - Any exceptions to the above mentioned policies must be approved in writing in advance.
9.PARKING PASSES - Parking passes are located inside the unit. Renters must display parking pass on the rear view mirror at all times. Failure to display may result in towing of vehicle at renter's expense. Leave the parking passes inside the unit upon departure.
FORCE MAJURE POLICY - No refunds will be given unless a National Emergency or Mandatory evacuation is given by prior to arrival by Civil defense, FIMA or other Goverment agency. No refunds will be given if stay is interrupted by inclement weather (No exceptions). In the case of Terrorism AKA “Act of God” during stay a pro rate of days will be refunded from date of incident, only if the guest decides to leave/abandon the property prior to last day of booking/stay.
Our time at the Turtle bay condo was very nice and relaxing. We enjoyed the use of the beach and restaurants as well as the great location to other nice beaches. We were disappointed when we found out that we could not use the resort pool. All in All our stay was very nice and relaxing.
Jason made us feel welcome, he was very friendly and made sure I knew where to find things if I needed anything. We had trouble once with the gate code not working, so I called Jason and just buzzed us in and ensured the issue was corrected. The condo was very comfortable and had everything we needed to enjoy our stay.
The Turtle Bay resort is a great location for exploring the North Shore. The listing description was accurate. Jason communicated timely and answered our questions.

We spent nice time in Jason's place, even if hurricane Isell came through the Island. But Jason had already warned us and we were very safe in his house.
Jason's place is very nice, one room, an open upper level with one double bed and a rollaway bed, and a big living room below.
Good location also, with nice beach at Turtle Bay Resort and around.
I booked Jason's 2 bedroom for 2 nights. He messaged me that he had a overbooking issue and asked me to change my dates if it was possible. We agreed to change the dates for him but the deal was to let us check in at 12pm instead of 3pm. But our room was not cleaned until 4pm. Then I noticed that it wasn't a 2 bedroom, it was a 1 bedroom…. Unfortunately, I think Jason forgot to mention that it would be a 1 bedroom instead of a 2 bedroom when he asked me to change the dates because of the overbooking issue. I am not perfect, nobody is perfect and I understand that we all make mistakes… still trying to resolve things… I know that the host did not do this intentionally, but he should be a lot more careful when booking because other people were mentioning in their reviews that there was a over booking issue (they were not mad though). It is very difficult to deal with clients when things go wrong… I know because I deal with high end clients and it is all about being sincere.
other than that, the place was clean with a nice pool and close to the beach.
This place is decent and a fine place to stay if you've got no kids or special needs. On the good side, it's roomy and close to the beach. The downsides are many: no air conditioning and it is literally a bare condo: few towels, no soap of any kind, no dish towels, sponges, dish soap, laundry detergent, nothing. Be ready to do major shopping when you get there. I wish we had known this up front, since in our case it would have made a good deal of difference (see below). Although the condo looks nice it is not in the greatest of shape and the cleaning people had not done a good job when we got there. The floor was dirty, the towels smelled mildewy, the shower curtain was moldy, and the bathrooms hadn't been cleaned thoroughly. It is very bare, not the sort of place you can arrive and immediately feel relaxed.
In our case, all of this made quite the difference because we were flying in with an 8 month old in tow. The condo is advertised as baby friendly but I would not recommend it to families with small children. We were told there would be a crib, flew in relatively late (for our kid, anyway) and arrived to find this not-completely-ready place, no crib in sight. We found out later it was in a closet somewhere, really a bassinet that was way too small for our kid. Jason had someone bring by a more appropriate packnplay the next day, but by that point we'd already spent a completely exhausting night basically holding our kid all night because a) she was exhausted from the trip, b) she was in a new place, and c) she had no appropriate place to sleep. All in all, not a great experience. We ended up leaving early because it was just really difficult to be there with a baby.
This was the only vacation we planned to take this year and I have to say I was pretty disappointed with the results. Jason was available to answer the phone and kind, but the setup of the condo just wasn't right for us. Bottom line, if the original ad for this place had been a bit clearer about what it was and wasn't, we would have booked somewhere else.
Very sorry you had to cut you trip short, however we did not know the age of your child , we provided a basinet and the following morning a pack and play. The home has never had a bad report of cleaning however we did report back to our company that there was sand in the in main bathroom. Families traveling with children are recomended to take their needs into consideration, we understand the constraints this puts on a trip. We do not provide laundry as part of the listing however we did open it up to your group at no charge. We did not have soap as we dont list with laundry as it had been broken by a guest and rather then charge then for breaking our unit we decided to not included it as it is not a properly treated item. We not that we provide towels but not beach towels, we replace if needed and we wash the old ones. However beach towels go missing so we dont list with such for guests. We have had two times now with travelers with young babies have canceled early and besides that never had this issue. Thus we are sorry you had a ruff trip but will no longer be renting to future guests with Babies as it seems the logistics of a vacation should be at a Hotel with laundry service not a homestay / condo. Good luck int he future and your valid points have been noted. Again I appreciate that you said this condo was NOT RIGHT FOR US. However this is our business and things need to be in context as we went over an above to provide what you needed when you need which is not part of the experience of renting a condo and thus should not be expected but appreciated when it happens.
