Valencia

In addition to the regional tourism regulations, hosts must comply with the zoning regulations that apply to tourist-use accommodations (VUTs) in Valencia, which may impose prohibitions or restrictions. Below is a brief overview of whether you can list tourist-use accommodations in Valencia, along with the zoning requirements and conditions to keep in mind.

I) Is it currently possible to obtain a license in Valencia?

Yes, it is possible to obtain a tourist-use accommodation (VUT) license in certain areas of Valencia, except Ciutat Central and the neighborhoods of Benimàmet, Carpesa, Poble Nou, la Punta, el Palmar, el Saler, and el Perellonet.

II) What zoning conditions apply to operating in Valencia?

If your property is not located in the restricted areas, the activity may be carried out on land designated for residential use and tertiary use.

You can check whether your property is assigned those uses at this link (select the “Lista de capas” (Layer List) section in the list of icons at the top right, uncheck all boxes except “Urbanismo(Zoning) and “PGOU – Calificaciones(PGOU – Classifications), and select your home on the map).

Currently, it is not possible to obtain new permits to operate, at least until May 30, 2026, for homes located in the following areas:

  • Ciutat Central.
  • Neighborhoods of Benimàmet, Carpesa, Poble Nou, la Punta, el Palmar, el Saler, and el Perellonet.

Within the Ciutat Vella area, the activity may only be carried out if both of the following conditions are met:

  • If the zoning plan indicates that the land where the tourist-use accommodation (VUT) is located has a “predominantly tertiary” use designation.
  • If it is a “building for exclusive use,” meaning it is used entirely for tourist use.

You can check whether your property has that use designation in this map.

III) What requirements must tourist-use accommodations meet?

At a minimum, tourist-use accommodations must have:

  • An evacuation plan for the building posted on the door of the home or, if that’s not available, emergency instructions in multiple languages.
  • Elevator, if the home is on the fifth floor or higher, or a separate entrance if the home is on the ground floor.
  • A 24/7 support phone number, a list of emergency and useful phone numbers posted in a visible place, and information about the location of the nearest medical center.
  • In-person key handoff service.
  • Electrical outlets with a voltage indicator in every room.
  • Hot water.
  • Air conditioning and heat, at least in the living-dining room.
  • Internet connection, unless the home is located in an area without coverage, and a television.
  • Cleaning service, linen and towel changes, and repairs and maintenance.

In addition, homes must be furnished and equipped with everything needed for immediate use (appliances, bed linens and towels, a first aid kit, cleaning supplies, etc.) and must comply with the applicable design and quality standards in the Valencian Community.

IV) What is the registration process?

To operate, you must submit a responsible declaration to the department responsible for tourism. You can access this process through this link.

After you complete the process, your home will be registered in the Valencian Community Tourism Registry and you’ll receive a registration number.

Contents of the responsible declaration

The responsible declaration must include:

  • Identification of the holder/manager of the activity and, where applicable, the property owner (including their email address and phone number).
  • The property’s unique, individualized cadastral reference number, or unique registry code.
  • A favorable urban-planning compatibility report for tourist use issued by the City Council, or an equivalent document issued by an Urban Planning Collaborating Entity (ECUV). In areas where there is a moratorium (that is, where the license-granting process has been temporarily paused) or where the planning regulations have been amended, this report must have been obtained within the six (6) months prior to submitting the responsible declaration.

In addition, you must provide proof of or declare the following:

  • That the home is available to be used for tourist accommodations and that you have documentation proving this (deed of ownership, lease agreement, etc.).
  • That you meet the requirements required by tourism regulations and that you will continue to meet them while you carry out the activity.
  • That you have a first or second occupancy permit, or an equivalent document.
  • That you have liability insurance or equivalent coverage.
  • That you have the certificate of habitability, the express authorization of the homeowners’ association to carry out the activity, and the property’s energy efficiency certificate.
  • The period of time during which the tourist activity will be carried out.
  • That you comply with the applicable tax, fiscal, and social security regulations, as well as the information-reporting obligations under Royal Decree 933/2021.
  • If the home is located on ordinary non-developable land, that you have obtained the declaration of community interest or that it is exempt under the applicable zoning legislation.
  • If the activity is carried out in a commercial premises, that you have the corresponding descriptive technical report.

How long is registration in the Tourism Registry valid?

Registration in the Tourism Registry is valid for five (5) years from the date you submit the responsible declaration.

You can renew the registration for another five (5) years. To do so, the holder must submit a responsible renewal declaration during the month before the deadline ends, taking into account the following:

  • If the registration was before July 8, 2018, you must state that you meet the requirements in section IV.
  • If the registration was between July 8, 2018, and August 7, 2024, the responsible declaration must refer to the items in section III (a), except for the homeowners’ association authorization, and you must submit an updated zoning compatibility certificate (or equivalent document).
  • If the registration is after August 8, 2024, the responsible declaration must refer to all items in section III (a), and you must submit an updated zoning compatibility certificate (or equivalent document).

If five (5) years pass and no renewal request is submitted, the home will be removed from the Tourism Registry.

What should you do if there is a change of ownership of a registered tourist-use accommodation?

If there is a change of ownership for a tourist-use accommodation that is already registered, the new owner or manager must submit a new responsible declaration, along with the municipal zoning compatibility report for favorable tourist use (or equivalent document).

Deadline to comply with current regulations for tourist-use accommodations registered before August 8, 2024

Tourist-use accommodations that were registered in the Tourism Registry before August 8, 2024, must comply with the requirements in section IV by August 8, 2029.

A change to the zoning regulations is currently being processed. As a result, the conditions described in this document could change.
