What are the consequences for private rooms in Catalonia and Barcelona after the 14th of June 2022 judgment by the High Court of Justice of Catalonia?

In its 14th of June 2022 judgment, the High Court of Justice of Catalonia has rendered effectless due to a formal defect the regime applicable to private rooms (home sharing) in the regional Catalonian regulations that were applicable since the 6th of August 2021. However, said regulations will continue to be in force and applicable without change up to the moment the Supreme Court accepts the cassation appeal which filing was announced by the Catalonian Government and, ultimately, adjudicates on the matter.

In Barcelona, where specific regulations apply to private rooms, the regime will also remain unaltered since the High Court did not adjudicate on the regulation applicable at city level.

In light of these events, Airbnb believes that the situation remains the same as on the 6th of August 2021. Hosts will have to bear in mind this legal landscape when offering private room
