Landlord and Tenant agree to lease the premises at the rent and for the terms and conditions as follows:

Upon signing of this Lease.
SECURITY DEPOSIT: Upon signing of the lease, the amount o(URL HIDDEN)payable by check to the order of Landlord as security to be held by the Landlord. Within 45 days following termination of the Lease, Landlord agrees to return security deposit to Tenant, adjusted for any damages or outstanding bills.
USE: The premises shall be used as a private dwelling only by the Tenant, the Tenant's family, employees, and non paying guests. Tenant shall comply with all laws and ordinances of the Town of Southampton respecting group occupancy, orderliness, cleanliness, preservation, and use of the premises. Landlord agrees that if Tenant pays the rent and is not in default under this Lease, Tenant may peaceably have, hold, and enjoy the premises for the term of this Lease.
UTILITIES & SERVICES: Tenant shall pay for all applicable utilities and services provided at the Premises, including: trash removal, fuel oil, gas, electric, telephone, cable television, wireless internet, grass cutting and grounds maintenance, pool maintenance, maid service.
A. The Tenant will prepay the Landlord $ towards the invoices and bills for all the above utilities and services for the term of the Lease which will be deducted from this prepayment of funds. The Tenant is responsible for any and all additional expenses for these utilities and services not covered by the prepayment. The Landlord will provide the Tenant with a meter reading at beginning of Lease period and at termination of the Lease as well as any and all bills associated with these utilities and services during the term of the Lease. The Landlord will return any of the prepayment funds to the Tenant which remain after the invoices and bills have been paid.
B. The Tenant at the expense of the Tenant shall keep the grounds in order.
C. The Landlord shall be responsible for the opening and closing of the swimming pool; the Tenant shall be responsible for the weekly maintenance of the pool. Propane and oil tanks will be filled upon occupancy; tenant will reimburse Landlord for amount of fuel consumed.
D. Tenant agrees to a weekly maid service and will pay her directly.
CONDITION OF PREMISES: Tenant agrees that at all times during this lease, the Premises will be kept in a clean and
orderly fashion and that at the termination of this Lease, the Premises will be delivered back to the Landlord with the rugs, floors and furniture clean and free from dirt; and the bathroom and kitchen (including appliances, cabinets, Dishware and utensils) cleaned. If the premises are not returned in such condition, the tenant agrees to pay for
professional cleaning services to properly clean the premises and articles of property, the cost of which shall be deducted
from the security deposit. Linens will be provided.
FURNITURE: Tenant acknowledges that the Premises are furnished and in good repair at the commencement of this
Lease and Tenant agrees to return the Premises in the same condition, reasonable wear and tear excepted, at the end of the lease term
REPAIRS, ALTERATIONS: Tenant shall keep and return the Premises and all appliances and furniture clean and in good repair. Landlord shall be responsible for repairs, except when a repair is required as a result of fault or abuse by Tenant, in which case Tenant shall pay for such repair. Tenant shall immediately notify Landlord, or Landlord's agent, of any condition requiring repair. No repair or alteration shall be made without the express consent of the Landlord. Tenant shall be reimbursed for any structural, plumbing or electrical problems deemed not to be the fault of the Tenant that would render the house unusable for more than 24 hours.
NOTICE OF DEFECTS: Within forty eight hours after taking possession of the Premises, the Tenant shall notify the Landlord or Landlord's agent of any malfunction in equipment, breakage or damage, which existed at the commencement of the term.
LANDLORD'S LIABILITY: Landlord shall not be liable for injury or damage to Tenant or any other person who uses or is in the Premises or be liable for damage to their property unless the same results from Landlord's negligence.
SUBLET: Tenant may not sublet all or part of the Premises or assign this Lease without the Landlord's written consent.
TENANT'S DEFAULTS(URL HIDDEN)Landlord may give five days written notice to Tenant to correct any of the following defaults:
1. Failure to pay rent or security deposit on time.
2. Improper assignment of the Lease, subletting all or part of the premises, or any violation of Paragraph 1.
3. Improper conduct by Tenant or other occupant of the Premises.
4. Failure to fully perform any term of the Lease.
If Tenant fails to correct the defaults in Section A within five days, Landlord may cancel the Lease by giving the Tenant a written three day notice stating the date the Term will end. On that date the Term and the Tenant's Rights in this Lease shall automatically end and Tenant must leave the Premises and give Landlord the keys.
Thereafter Tenant shall be responsible for rent, expenses (including attorney's fees), damages, and losses due as of date of termination.
FIRE DAMAGE: In case of fire, the Tenant shall give immediate notice thereof to the Landlord who shall thereupon cause the damage, if partial, to be repaired at once, but in case of such complete destruction by fire or otherwise (as determined at Landlord's sole discretion) as to render the Premises uninhabitable, the rent shall be apportioned and paid up to the time of such destruction and any overpayment shall be refunded and then and from thenceforth this lease shall cease and come to an end.
ACCESS TO PREMISES: Tenant shall permit Landlord or Landlord's agent to inspect or show the Premises for rent or for sale at reasonable daytime hours by appointment, and with at least 24 hour advance notice.
BROKER: there is no Broker or broker's commission in this transaction except Airbnb's fee.
NO GROUP SHARING: The Tenant shall not sell shares to any person nor may the Tenant sublet or lease any portion of the Premises to any person without the written consent of the Landlord. The Town of Southampton regulates the number of "unrelated individuals" that may occupy the Premises. Tenant agrees to comply with these regulations. If any of these conditions are violated, they shall be deemed a material breech of this lease and grounds for eviction.
REIMBURSEMENT: If the Landlord shall pay or be liable to pay any sum or sums of money whatsoever, or do or perform any act or thing on behalf of the tenant, or make good any default by the tenant hereunder, or if any penalty be assessed or imposed against the Landlord because of any default of the Tenant under this Lease, any amount paid by the Landlord together with all interest, costs, expenses, attorney's fees and damages, may be paid by the Landlord out of such security deposit or may be deducted therefrom.
PLUMBING: The Tenant shall be responsible for removing all stoppages in the kitchen or bathroom drains, if necessary.
INSURANCE: The Tenant agrees to add the Landlord's Premises as a secondary residence on the Tenant's existing Home Owner's Insurance or to secure a Tenant's Insurance Policy and shall provide Landlord with a Certificate of Insurance reasonably acceptable to Landlord.
ATTORNEY'S FEES: In any successful action to enforce any of the provisions of this Lease or in any successful action for eviction hereunder, the Landlord shall be entitled to attorney's fees which shall calculated on the basis of 15% of the annual or seasonal rent provided for herein, in addition to all costs, disbursements and allowances otherwise provided by law.
PETS: Pets are permitted on premises with written consent of the Landlord.
No smoking is permitted in the house.
